IN-CONTEXT TRANSLATIONS

Pendant la même période transitoire initiale de sept ans, les contributions des États membres qui ratifient le présent accord ou y adhèrent après son entrée en vigueur sont calculées en fonction du nombre de brevets européens produisant leurs effets sur le territoire de l'État membre ratifiant l'accord ou y adhérant à la date de la ratification ou de l'adhésion et du nombre de brevets européens au sujet desquels des actions en contrefaçon ou en nullité ont été engagées devant les juridictions nationales de l'État membre ratifiant l'accord ou y adhérant au cours des trois années précédant la ratification ou l'adhésion.
During the same initial transitional period of seven years, for Member States which ratify, or accede to, this Agreement after the entry into force thereof, the contributions shall be calculated on the basis of the number of European patents having effect in the territory of the ratifying or acceding Member State on the date of the ratification or accession and the number of European patents with respect to which actions for infringement or for revocation have been brought before the national courts of the ratifying or acceding Member State in the three years preceding the ratification or accession.

3. Pendant la période transitoire initiale de sept ans à partir de la date d'entrée en vigueur du présent accord, la contribution de chaque État membre contractant ayant ratifié l'accord ou y ayant adhéré avant son entrée en vigueur est calculée en fonction du nombre de brevets européens produisant leurs effets sur le territoire de l'État concerné à la date d'entrée en vigueur du présent accord et du nombre de brevets européens au sujet lesquels des actions en contrefaçon ou en nullité ont été engagées devant les juridictions nationales dudit État au cours des trois années précédant l'entrée en vigueur du présent accord.
3. During the initial transitional period of seven years, starting from the date of the entry into force of this Agreement, the contribution by each Contracting Member State having ratified or acceded to the Agreement before the entry into force thereof shall be calculated on the basis of the number of European patents having effect in the territory of that State on the date of entry into force of this Agreement and the number of European patents with respect to which actions for infringement or for revocation have been brought before the national courts of that State in the three years preceding entry into force of this Agreement.

Il convient de laisser aux demandeurs de brevets la possibilité d’obtenir, au choix, un brevet national, un brevet européen à effet unitaire, un brevet européen produisant ses effets dans un ou plusieurs États parties à la CBE ou un brevet européen à effet unitaire validé également dans un ou plusieurs États parties à la CBE qui ne figurent pas parmi les États membres participants.
Patent applicants should remain free to obtain either a national patent, a European patent with unitary effect, a European patent taking effect in one or more of the Contracting States to the EPC or a European patent with unitary effect validated in addition in one or more other Contracting States to the EPC which are not among the participating Member States.
