(8) Conformément aux principes généraux du droit des brevets et à l'article 64, paragraphe 1, de la CBE, la protection par brevet unitaire devrait prendre effet rétroactivement sur le territoire des États membres participants, à compter de la date où a été publiée la mention de la délivrance du brevet européen dans le Bulletin européen des brevets.
(8) In accordance with the general principles of patent law and Article 64(1) of the EPC, unitary patent protection should take effect retroactively in the territories of the participating Member States as of the date of the publication of the mention of the grant of the European patent in the European Patent Bulletin.

(12) As an object of property, a European patent with unitary effect should be dealt with in its entirety, and in all the participating Member States, as a national patent of the participating Member State in which, according to the European Patent Register, the proprietor of the patent had his residence or principal place of business on the date of filing of the patent application.
