En tant qu’objet de propriété, le brevet européen à effet unitaire est assimilé dans son intégralité, et dans tous les États membres participants, à un brevet national de l’État membre participant dans lequel, selon le Registre européen des brevets, le titulaire du brevet avait son domicile ou son principal établissement à la date du dépôt de la demande de brevet.
A European patent with unitary effect as an object of property shall be dealt with in its entirety, and in all the participating Member States, as a national patent of the participating Member State in which, according to the European Patent Register, the proprietor of the patent had his residence or principal place of business on the date of filing of the application for the patent.

3. 3. Where no proprietor has his/her residence, principal place of business or place of business in a participating Member State in which that patent has unitary effect for the purposes of paragraphs 1 or 2, the European patent with unitary effect as an object of property shall be dealt with in its entirety and in all the participating Member States as a national patent of the State where the European Patent Organisation has its headquarters in accordance with Article 6(1) of the EPC.

On request, the Commission may grant a compulsory licence in respect of a first patent to the proprietor of a national or Community patent or to the proprietor of a plant variety right who cannot use his patent (second patent) or his national or Community plant variety right without infringing a Community patent (first patent), provided that the invention or new plant variety claimed in the second patent or plant variety right involves an important technical advance of considerable economic significance in relation to the invention claimed in the first patent.
