Étant donné la spécificité des affaires dont aura à connaître le Tribunal du brevet communautaire (à savoir des litiges entre particuliers en matière de brevets), certaines dispositions du statut de la Cour de justice ne peuvent être applicables (notamment celles relatives au réexamen de la légalité d'actes communautaires), d'autres doivent être modifiées (notamment celles relatives à la procédure, à la production de preuves ou à la révision des arrêts), tandis que de nouvelles dispositions doivent être ajoutées (notamment concernant l'exécution forcée des décisions du Tribunal du brevet communautaire ou les frais de procédure).
With a view to the special nature of litigation before the Community Patent Court, i.e. private party patent litigation, some provisions of the Statute of the Court of Justice cannot apply e.g. those concerning the review of the legality of Community acts, others need amendments e.g. those concerning the procedure, the production of evidence or the revision of a judgment and finally some provisions need to be added e.g. those concerning the enforcement of decisions of the Community Patent Court or court fees.

In such situations, the second patent (or plant variety right) must, under Article 31(l) of the TRIPS Agreement, involve an important technical advance in relation to the invention claimed in the first patent; the proposed provision authorises the Commission to adopt any measure it considers appropriate in order to verify that these requirements have been met.
