L'article 46 du projet de règlement sur le brevet communautaire précise à cet égard que les juridictions nationales restent compétentes pour connaître des actions ne relevant pas de la compétence exclusive conférée à la Cour de justice, par exemple pour des litiges relatifs à la propriété d'un brevet communautaire.
Article 46 of the draft Community patent regulation clarifies in this regard that national courts remain competent for any action for which exclusive jurisdiction is not conferred on the Court of Justice which for example is the case in disputes concerning the ownership of a Community patent.
