Ainsi, en faisant procéder au recrutement d’une connaissance proche, M. Berthelot, en qualité de visiteur scientifique, alors qu’il n’allait pas exercer les activités correspondantes, cela afin de permettre à l’intéressé d’occuper des fonctions de conseiller personnel à son cabinet, quand bien même celui-ci était déjà complet et que, de surcroît, M. Berthelot avait dépassé l’âge limite autorisé pour assurer de telles fonctions, Mme Cresson s’est rendue responsable d’un manquement d’un certain degré de gravité.
