The first reporting of group data pursuant to Article 3a following the entry into force of Regulation (EU) 2018/318 of the European Central Bank (ECB/2018/7) (*2) shall start with data for the reference period September 2018.

2. Nonobstant le paragraphe 1, si la BCE commence à accomplir les missions qui lui sont confiées avant le 4 novembre 2014, elle peut demander aux autorités compétentes nationales de lui communiquer l’identité des établissements de crédit concernés ainsi qu’un rapport dans le format spécifié par la BCE dans un délai raisonnable, qui sera précisé dans la demande.

Notwithstanding paragraph 1, if the ECB starts carrying out the tasks conferred on it before 4 November 2014, it may request NCAs to communicate to the ECB the identity of the relevant credit institutions as well as a report in a format specified by the ECB within a reasonable time limit, which shall be stated in the request.

2. Notwithstanding paragraph 1, if the ECB starts carrying out the tasks conferred on it before 4 November 2014, it shall address a decision to the entity concerned and to the relevant NCAs.

If the ECB assumes direct supervision of a supervised entity or a supervised group either on the basis of a request for or receipt of direct public financial assistance from the ESM, the ECB shall notify the ECB decision referred to in paragraph 1 to each supervised entity concerned in due time, at least one week prior to the date on which it will assume direct supervision.

Notwithstanding paragraph 2, if the ESM unanimously requests the ECB to take over direct supervision of a credit institution, financial holding company or mixed financial holding company as a precondition for its direct recapitalisation, the ECB may immediately start carrying out the tasks conferred on it by this Regulation in respect of that credit institution, financial holding company or mixed financial holding company, and following a decision addressed to the entities concerned and to the national competent authorities concerned.

In order to ensure that credit institutions are subject to supervision of the highest quality, unfettered by other, non-prudential considerations, and that the negative mutually reinforcing impacts of market developments which concern credit institutions and Member States are addressed in a timely and effective way, the ECB should start carrying out specific supervisory tasks as soon as possible.

2. Les procédures d’appel d’offres entamées avant l’entrée en vigueur de la présente décision sont achevées conformément aux dispositions de la décision BCE/2007/5 en vigueur à la date à laquelle la procédure d’appel d’offres à commencé.
2. Tender procedures started before the entry into force of this Decision shall be completed in accordance with the provisions of Decision ECB/2007/5 in force at the date when the tender procedure started.

Si les irrégularités concernent l’invitation à soumissionner ou les autres documents envoyés par la BCE, le délai commence à courir à partir de la date de réception de la documentation.
If the irregularities affect the invitation to tender or other documents sent by the ECB, the time limit shall start to run from the date of receipt of the documentation.
