2. L’institution ayant perçu des cotisations à titre provisoire auprès d’une personne physique et/ou morale ne procède au remboursement des montants en question en faveur des personnes qui les ont payés qu’après avoir interrogé l’institution reconnue comme compétente sur les sommes qui lui seraient dues en application de l’article 6, paragraphe 4, du règlement d’application.

The institution which has provisionally received contributions from a legal and/or natural person shall not reimburse the amounts in question to the person who paid them until it has ascertained from the institution identified as being competent the sums due to it under Article 6(4) of the implementing Regulation.

For the application of this Directive, a protection measure may have been imposed following a judgment within the meaning of Council Framework Decision 2008/947/JHA of 27 November 2008 on the application of the principle of mutual recognition to judgments and probation decisions with a view to the supervision of probation measures and alternative sanctions , or following a decision on supervision measures within the meaning of Council Framework Decision 2009/829/JHA of 23 October 2009 on the application, between Member States of the European Union, of the principle of mutual recognition to decisions on supervision measures as an alternative to provisional detention .
