Quand bien même le principe de l'investisseur privé avisé en économie de marché serait applicable, au regard des pièces transmises par les autorités françaises qui ont éclairé, selon elles, les perspectives de rentabilité et les risques attachés au prétendu investissement sous forme d'exonération d'impôt, l'application du test du principe de l'investisseur privé en économie de marché permet de conclure qu'un investisseur privé avisé n'aurait pas investi un montant égal à l'impôt dû dans l'augmentation de capital d'EDF en 1997.
Even if the principle of the prudent private investor in a market economy were applicable, in the light of the documents provided by the French authorities shedding light, according to them, on the profit expectations and risks attached to the alleged investment in the form of a tax exemption, application of the test of the private investor in a market economy leads to the conclusion that a prudent private investor would not have invested an amount equal to the tax due in the EDF capital increase in 1997.
