Considérant que le grade AD 5 ne correspondait ni aux fonctions prévues par l’avis de vacance ni à celles qu’il exerçait et qu’il avait fait l’objet d’une discrimination par rapport aux fonctionnaires de l’Union, le requérant a introduit une « [demande au sens de l’article 90, paragraphe 2, du statut] » le 27 juin 2013, avec pour objectif de redresser une erreur manifeste d’appréciation dans son classement.
Considering that grade AD 5 did not correspond either to the functions described in the vacancy notice or those he was performing and that he had been discriminated against in relation to EU officials, the applicant submitted a ‘Request under Article 90(2) [of the Staff Regulations]’ on 27 June 2013, with the objective of rectifying a manifest error of assessment in his grading.

3. Lorsque le Conseil est saisi d'une question conformément aux dispositions du paragraphe 2 du présent article, il approuve lesdites notes explicatives, avis de classement, autres avis ou recommandations, à moins qu'un État membre du Conseil qui est partie contractante à la présente convention ne demande à les renvoyer en totalité ou en partie devant le Comité pour un nouvel examen.
3. Where a matter is referred to the Council under the provisions of paragraph 2 of this Article, the Council shall approve such Explanatory Notes, Classification Opinions, other advice or recommendations, unless any Council Member which is a Contracting Party to this Convention requests that they be referred in whole or part to the Committee for re-examination.

2. Les notes explicatives, les avis de classement, les autres avis se rapportant à l'interprétation du système harmonisé et les recommandations visant à assurer une interprétation et une application uniformes du système harmonisé qui ont été rédigés au cours d'une session du Comité du système harmonisé conformément aux dispositions du paragraphe 1 de l'article 7, sont réputés avoir été approuvés par le Conseil si, avant la fin du deuxième mois qui suit celui au cours duquel cette session a été close, aucune partie contractante à la présente convention n'a notifié au secrétaire général qu'elle demande que la question soit soumise au Conseil.
2. The Explanatory Notes, Classification Opinions, other advice on the interpretation of the Harmonized System and recommendations to secure uniformity in the interpretation and application of the Harmonized System, prepared during a session of the Harmonized System Committee under the provisions of paragraph 1 of Article 7, shall be deemed to be approved by the Council if, not later than the end of the second month following the month during which that session was closed, no Contracting Party to this Convention has notified the Secretary-General that it requests that such matter be referred to the Council.
