2. Member States shall take the necessary measures to ensure that employers, when recruiting a person for professional or organised voluntary activities involving direct and regular contacts with children, are entitled to request information in accordance with national law by way of any appropriate means, such as access upon request or via the person concerned, of the existence of criminal convictions for any of the offences referred to in Articles 3 to 7 entered in the criminal record or of the existence of any disqualification from exercising activities involving direct and regular contacts with children arising from those criminal convictions.

Les États membres prennent les mesures nécessaires pour que, aux fins des paragraphes 1 et 2 du présent article, les informations relatives à l’existence de condamnations pénales pour toute infraction visée aux articles 3 à 7, ou de toute mesure d’interdiction d’exercer des activités impliquant des contacts directs et réguliers avec des enfants consécutive auxdites condamnations pénales, soient transmises conformément aux procédures énoncées dans la décision-cadre 2009/315/JAI du Conseil du 26 février 2009 concernant l’organisation et le contenu des échanges d’informations extraites du casier judiciaire entre les États membres , lorsque ces informations sont demandées au titre de l’article 6 de ladite décision-cadre avec l’accord de la personne concernée.

Member States shall take the necessary measures to ensure that, for the application of paragraphs 1 and 2 of this Article, information concerning the existence of criminal convictions for any of the offences referred to in Articles 3 to 7, or of any disqualification from exercising activities involving direct and regular contacts with children arising from those criminal convictions, is transmitted in accordance with the procedures set out in Council Framework Decision 2009/315/JHA of 26 February 2009 on the organisation and content of the exchange of information extracted from the criminal record between Member States when requested under Article 6 of that Framework Decision with the consent of the person concerned.

Le mécanisme mis en place par la présente décision-cadre vise notamment à faire en sorte qu'une personne qui a été condamnée pour une infraction sexuelle commise à l'égard d'enfants ne soit plus en mesure, lorsque son casier judiciaire dans l'État membre de condamnation comporte ce type de condamnation et, le cas échéant, une déchéance consécutive inscrite dans le casier judiciaire, de dissimuler cette condamnation ou déchéance afin d'exercer une activité professionnelle liée à la surveillance d'enfants dans un autre État membre.
The mechanism established by this Framework Decision aims at inter alia ensuring that a person convicted of a sexual offence against children should no longer, where the criminal record of that person in the convicting Member State contains such conviction and, if imposed and entered in the criminal record, a disqualification arising from it, be able to conceal this conviction or disqualification with a view to performing professional activity related to supervision of children in another Member State.
