La Commission présente, avant le 1er janvier 2017 et chaque année par la suite, au Parlement européen et au Conseil un rapport précisant si les AES lui ont soumis les projets de normes techniques de réglementation et les projets de normes techniques d'exécution prévus dans les directives 2003/71/CE et 2009/138/CE, qu'elles soient tenues ou non d'élaborer de tels projets de normes techniques de réglementation ou de normes techniques d'exécution, avec les propositions, le cas échéant.
The Commission shall, by 1 January 2017 and annually thereafter, submit to the European Parliament and to the Council a report specifying whether the ESAs have submitted the draft regulatory technical standards and implementing technical standards provided for in Directives 2003/71/EC and 2009/138/EC, whether the submission of such draft regulatory technical standards or implementing technical standards is mandatory or optional, together with proposals, where appropriate.

Before submitting them to the Commission, the Authority shall conduct open public consultations on draft regulatory technical standards and analyse the potential related costs and benefits, unless such consultations and analyses are disproportionate in relation to the scope and impact of the draft regulatory technical standards concerned or in relation to the particular urgency of the matter.
