En effet, même si la décision attaquée était motivée par le caractère déraisonnable des taux de rémunération proposés par Microsoft et non par le refus d’accorder l’accès aux informations relatives à l’interopérabilité, le fait que la Commission avait accepté, au vu de la litispendance, que Microsoft applique, pendant une certaine période, une pratique pouvant entraîner le maintien d’une situation que la décision de 2004 avait pour objet de supprimer, pourrait être pris en compte dans le cadre de la détermination de la gravité du comportement sanctionné et, dès lors, du montant de l’astreinte.
Even though the contested decision was based on the unreasonable nature of the remuneration rates proposed by Microsoft and not on the refusal to allow access to the interoperability information, the Commission’s acceptance, in the light of the pending case, that Microsoft could apply, for a certain period, a practice that might entail the preservation of a situation which the 2004 decision was intended to bring to an end, could be taken into account in determining the gravity of the conduct found to be unlawful and, therefore, the amount of the periodic penalty payment.
