M. whereas the Bangladesh Labour Act (Labour Law) was amended in July 2013; whereas the law, while including some positive reforms such as in the area of occupational health and safety, continues to fall short of international standards with regard to freedom of association and collective bargaining, as highlighted by the ILO Committee of Experts’ comments on Conventions 87 and 98, including limitations on the right to elect representatives in full freedom, numerous limitations on the right to strike and broad administrative powers to cancel a union’s registration, and whereas the government has stated repeatedly that it has no intention of considering additional amendments;

L. considérant que la loi bangladaise sur le travail de 2013, qui lance des réformes positives, reste toutefois très insuffisante au regard des normes internationales relatives à la liberté syndicale et au droit à la négociation collective, comme le souligne la commission d'experts de l'OIT dans ses observations sur les conventions 87 et 98, notamment en ce qu'elle limite considérablement le droit d'élire librement des représentants et le droit de grève et confère de larges pouvoirs aux administrations pour annuler la création d'un syndicat; que le gouvernement bangladais a déclaré à plusieurs reprises qu'il n'avait aucune intention d'y apporter de nouvelles modifications;
L. whereas the revised Bangladesh Labour Act (BLA) of 2013, while including some positive reforms, continues to fall well short of international standards with regard to freedom of association and collective bargaining, as highlighted by the ILO Committee of Experts’ comments on Conventions 87 and 98, including limitations on the right to elect representatives in full freedom, numerous limitations on the right to strike and broad administrative powers to cancel a union’s registration, and whereas the government has stated repeatedly that it has no intention of considering additional amendments;

En l’espèce, il a également été tenu compte d’autres facteurs importants, à savoir le fait que la valeur transférée par Lundbeck prenait en considération le chiffre d’affaires ou le bénéfice que le fabricant de génériques escomptait réaliser s’il avait réussi son entrée sur le marché; le fait que Lundbeck n’aurait pu obtenir les restrictions à l’entrée en rendant exécutoires ses brevets de procédé, étant donné que les obligations imposées au fabricant de génériques dans l’accord allaient au-delà des droits accordés aux titulaires des brevets de procédé; et le fait que l’accord ne contenait aucun engagement de la part de Lundbeck de ne pas intenter d’action si le fabricant de génériques commercialisait le citalopram générique après l’expiration de l’accord.
In the present case other important factors were also taken into consideration, namely: the fact that the value which Lundbeck transferred took into consideration the turnover or the profit the generic undertaking expected if it had successfully entered the market; the fact that Lundbeck could not have obtained the limitations on entry through enforcement of its process patents, the obligations on the generic undertaking in the agreement going beyond the rights granted to holders of process patents; and the fact that the agreement contained no commitment from Lundbeck to refrain from infringement proceedings if the generic undertaking entered the market with generic citalopram after expiry of the agreement.

La résolution Conf. 12. 3 (Rev. CoP13) de la CITES relative aux permis et aux certificats autorise la délivrance rétroactive de permis pour les objets personnels ou à usage domestique lorsque l'organe de gestion n’a aucun doute sur le caractère involontaire de l’erreur commise et est convaincu qu’il n’y avait pas intention de tromperie. Cette résolution impose aux parties de signaler de tels permis dans les rapports bisannuels soumis au secrétariat.
CITES Resolution Conf. 12. 3 (Rev. CoP13) on Permits and Certificates allows for permits to be issued retrospectively for personal and household effects, where the Management Authority is satisfied that a genuine error was made and that there was no attempt to deceive, and requires Parties to report on such permits in the biennial reports to the Secretariat.

‘As regards specimens imported or (re-)exported as personal and household effects, to which the provisions of Chapter XIV apply, and as regards personally owned live animals, which are legally acquired and held for personal non-commercial purposes, the derogation provided for in paragraph 1 shall also apply where the competent management authority of the Member State, in consultation with the relevant enforcement authority, is satisfied that there is evidence that a genuine error has been made and that there was no attempt to deceive and the import or (re-)export of the specimens concerned is in compliance with Regulation (EC) No 338/97, the Convention and the relevant legislation of a third country’.

However, the China Chamber of Commerce of Metals, Minerals and Chemicals Importers and Exporters, henceforward referred to as the 'China Chamber of Commerce', brought itself to the attention of the Commission and informed it that it intended to reply to the questionnaires on behalf of all the Chinese exporters and producers referred to above.
