Il convient de réexaminer l'article 7 de la décision d'exécution 2014/709/UE, qui prévoit une dérogation à l'interdiction d'expédier des lots de sous-produits animaux tirés d'animaux de l'espèce porcine à partir des zones mentionnées dans les parties III et IV de l'annexe de ladite décision d'exécution, afin de permettre une élimination sûre des sous-produits animaux tirés de porcs autres que les porcs sauvages, y compris les cadavres non transformés d'animaux, provenant d'exploitations situées dans les zones mentionnées dans la partie III de l'annexe, d'une manière adaptée au risque représenté par ces sous-produits animaux.
Article 7 of Implementing Decision 2014/709/EU, providing for a derogation from the prohibition on the dispatch of consignments of animal by-products from porcine animals from the areas listed in Parts III and IV of the Annex to that Implementing Decision, should be reviewed in order to allow for a safe disposal of animal by-products of porcine origin other than feral pigs, including unprocessed bodies of dead animals, from holdings located in the areas listed in Part III of the Annex in a manner that is in line with the risk represented by these animal by-products.

(14) Regulation (EC) No 1069/2009 of the European Parliament and the Council of 21 October 2009 laying down health rules as regards animal by-products and derived products not intended for human consumption and repealing Regulation (EC) No. 1774/2002 (Animal by-products Regulation)[15] lays down both public and animal health rules for certain animal by-products and derived products in order to prevent and minimise risks to public and animal health arising from those products, and in particular to protect the safety of the food and feed chain.

Other information: As regards the funds planned for 2010 to assist with the management of animal by-products, and in view of the fact that 1 March 2010 saw the entry into force of a new State aid scheme for the removal and destruction of animal by-products not destined for human consumption, the forecast amounts for the collection and processing of animal by-products did not correspond to reality: since greater quantities of animal by-products presenting a risk of transmitting spongiform encephalopathy (from bovine animals aged over 24 months, and sheep and goats aged over 18 months) had been anticipated, it was decided to subsidise the removal and destruction costs of these at the rate of 100 %.

In particular, the Commission should be empowered to adopt rules modifying the end point in the manufacturing chain of certain derived products and establishing such an end point for certain other derived products, rules in regard to serious transmissible diseases in the presence of which the dispatch of animal by-products and derived products should not be allowed and/or the conditions allowing such a dispatch, measures changing the categorisation of animal by-products and derived products, measures regarding restrictions on the use and disposal of animal by-products and derived products, measures laying down conditions for the application of certain derogations regarding the use, collection and disposal of animal by-products and derived products and measures authorising or rejecting a particular alternative method for the use and disposal of animal by-products and derived products.

In addition, the Commission should be empowered to adopt more specific rules concerning collection and transport of animal by-products and derived products, the infrastructure, equipment and hygiene requirements for establishments or plants handling animal by-products and derived products, the conditions and technical requirements for the handling of animal by-products and derived products, including the evidence to be presented for the purpose of validation of such treatment, conditions for the placing on the market of animal by-products and derived products, requirements related to safe sourcing, safe treatment and safe end uses, conditions for the import, transit and export of animal by-products and derived products, detailed arrangements for implementing official controls including rules concerning the reference methods for microbiological analyses as well as conditions for the control of the dispatch of certain animal by-products and derived products between Member States.

(69) In particular, the Commission should be empowered to adopt rules concerning the site and equipment of plants and establishments handling animal by-products, the handling and treatment of animal by-products, the categorisation of materials according to the risk arising from them to public and animal health, measures intended to ensure the traceability of animal by-products, derogations regarding the use and disposal of animal by-products, conditions for the placing on the market of animal by-products and derived products, conditions for the control for the dispatch of certain animal by-products and derived products between Member States and conditions for the import and transit of animal by-products and derived products.

(12) Les dispositions du présent règlement relatives aux sous-produits animaux doivent s’appliquer non seulement aux produits impropres à la consommation humaine selon la législation communautaire, notamment aux produits non conformes à la législation sur l’hygiène des denrées alimentaires (sous-produits animaux «en application de la loi»), mais également aux produits remplissant certaines conditions pour être utilisés dans l’alimentation humaine, même s’ils peuvent être utilisés à d’autres fins (sous-produits animaux «par choix»).
(12) The rules on animal by-products laid down in this Regulation should apply to products that may not be used for human consumption under Community legislation, in particular where they do not comply with food hygiene legislation (animal by-products "by law"). Those rules should, however, also apply to products which do comply with certain rules regarding their possible use for human consumption, even if they are eventually destined for other purposes (animal by-products "by choice").
