La Commission reproche, premièrement, à la France de ne pas avoir prévu la séparation des entités assurant l'exploitation des services ferroviaires (en l’occurrence, la Société nationale des chemins de fer français, « SNCF ») de celles chargées de gérer l'infrastructure (Réseau ferré de France, « RFF »), notamment en ce qui concerne l’exercice des fonctions considérées comme essentielles, dont l’allocation des sillons ferroviaires (directive 91/440/CEE) . Or, la SNCF, à travers la Direction des Circulations Ferroviaires (« DCF »), qui à l’époque n’était pas indépendante de la SNCF, demeurerait chargée de l'attribution des sillons.
The Commission alleged, first, that France did not make provision for the separation of SNCF, the entity providing rail transport services, from RFF, the organisation responsible for managing the infrastructure in particular as regards the performance of functions deemed essential, which included the allocation of train paths (Directive 91/440/EEC) . It claimed that the SNCF, through the Direction des circulations ferroviaires (‘DCF’), which at the time was not independent of SNCF, remained in charge of the allocation of train paths.

Quant au fond, la Cour constate, qu’à cette date, la réglementation française ne respectait pas le critère d’indépendance de la fonction d’allocation des sillons ferroviaires.
As regards the merits of the case, the Court finds that, on that date, French legislation did not comply with the criterion that the function of allocating rail paths must be performed independently.

Par conséquent, une entreprise ferroviaire ne peut se voir confier la réalisation d’études techniques d’exécution nécessaires à l’instruction des demandes de sillons, effectuée en amont de la prise de décision et à l’attribution des sillons de dernière minute, étant donné que ces études participent à la définition et à l’évaluation de la disponibilité des sillons, et que leur attribution de dernière minute constitue une attribution de sillons individuels au sens de la directive 91/440.
Consequently, a railway undertaking may not be entrusted with conducting the technical implementation studies necessary for scrutinising applications for train paths which must be carried out before a decision is taken and for the last-minute allocation of train paths, because those studies form part of the definition and assessment of the availability of train paths and the last-minute allocation of train paths constitutes an allocation of individual train paths for the purposes of Directive 91/440.

3. En cas de plainte ou d'enquête lancée de sa propre initiative sur des questions d'accès ou de tarification relatives à un sillon international, ainsi que dans le cadre de la surveillance de la concurrence sur le marché concernant des services de transport ferroviaire international, l'organisme de contrôle concerné consulte les organismes de contrôle de tous les autres États membres par lesquels passe le sillon international en cause et, le cas échéant, la Commission, et leur demande toutes les informations nécessaires avant de prendre sa décision.
3. In the case of a complaint or an own-initiative investigation on issues of access or charging relating to an international train path, as well as in the framework of monitoring competition on the market related to international rail transport services, the regulatory body concerned shall consult the regulatory bodies of all other Member States through which the international train path concerned runs and, where appropriate, the Commission, and shall request all necessary information from them before taking its decision.
