For the purposes of point (b) of the first subparagraph, the verifier’s impartiality shall be considered compromised where the relations between the verifier and the consultancy body, technical assistance body or the other organisation is based on common ownership, common governance, common management or personnel, shared resources, common finances, common contracts or marketing and common payment of sales commission or other inducement for the referral of new clients.

Si, sur la base des notifications fournies par les États membres conformément aux alinéas 2 et 3, ou, compte tenu de nouveaux avis scientifiques, la Commission estime que les conditions requises pour obtenir une dérogation ne sont pas remplies, elle peut, après avoir consulté l'État membre concerné, demander à cet État de modifier la dérogation ou peut proposer au Conseil de prendre les mesures qui conviennent pour assurer la protection des ressources et de l'environnement.
If the Commission, on the basis of the notifications provided by Member States in accordance with subparagraphs 2 and 3, or of new scientific advice, considers that the conditions for a derogation are not met, it may, after having consulted the Member State concerned, ask it to amend the derogation or may propose to the Council appropriate measures for the protection of the resources and the environment.

In the case of credit institutions other than those which are set up in areas newly reclaimed from the sea or have resulted from scission or mergers of existing institutions dependent or answerable to the central body, the Commission, pursuant to the procedure referred to in Article 151(2) may lay down additional rules for the application of the second subparagraph including the repeal of exemptions provided for in the first subparagraph, where it is of the opinion that the affiliation of new institutions benefiting from the arrangements laid down in the second subparagraph might have an adverse effect on competition.

14) À l'article 101, l'alinéa suivant est inséré après le deuxième alinéa:"Toutefois, la ou les superficies de base régionales des nouveaux États membres sont fixées par la Commission conformément à la procédure visée à l'article 144, paragraphe 2, et dans les limites des superficies de base nationales énumérées à l'annexe XI ter".
14. In Article 101, the following paragraph is inserted after the second paragraph:"However, the regional base area or areas in the new Member States shall be fixed by the Commission in accordance with the procedure referred to in Article 144(2) and within the limits of the national base areas listed in Annex XIb".
