For the purposes of considering the exclusion, on the grounds of his participation in a terrorist organisation, of a person seeking international protection, is the judgment convicting him of being a leading member of a terrorist organisation, which finds that the person seeking international protection has not committed, attempted to commit or threatened to commit a terrorist act, sufficient for a finding of the existence of an act of participation or instigation within the meaning of Article 12(3) of Directive 2004/83/EC imputable to that person, or is it necessary for an individual examination of the facts of the case to be made and participation demonstrated in the commission of a terrorist offence or instigation of a terrorist offence as defined in Article 1 of Framework Decision 2002/475/JHA of 13 June 2002 on combating terrorism?

These include in particular the replacement of structured and hierarchical groups by semi-autonomous cells or lone actors and the increased use of the internet to inspire, mobilise, instruct and train local terrorist networks and individuals.[9] The provisions in place to implement FD 2002 were considered insufficient in that conduct such as disseminating messages of public provocation which did not actually incite a particular person to commit a terrorist offence, disseminating messages encouraging people to become terrorists without reference to a specific terrorist offence, or disseminating on the internet terrorist expertise not aimed at supporting the activities of a specific terrorist group, were not necessarily criminalised.

The obligation to provide information would not be defined by reference to a list of persons and entities, however broad, but to all the offences defined by Framework Decision 2002/475/JHA on combating terrorism with which the Member States are acquainted: terrorist offences, offences relating to a terrorist group, including all forms of financing for its activities, offences linked to terrorist activities and incitement, complicity and attempts.
