E. considérant que plusieurs des attentats récemment perpétrés par le groupe État islamique, notamment celui qui a visé le camp d'entraînement de Zliten, le 7 janvier 2016, ainsi que d'autres attaques menées contre des infrastructures pétrolières et des installations de stockage, témoignent de l'intensification des activités du groupe terroriste dans le pays; que jusqu'à 3000 combattants du groupe État islamique résideraient actuellement dans la ville de Sirte et que le groupe étend son influence le long de la côte méditerranéenne; que le nombre des combattants étrangers se rendant en Libye pour rejoindre des organisations terroristes a fortement augmenté;
E. whereas a number of recent terrorist attacks by ISIS/Daesh, including an attack on a training centre in Zliten on 7 January 2016 and other attacks on oil infrastructures and storage facilities, show an increase in activity by the terrorist group in the country; whereas up to 3 000 ISIS/Daesh fighters are now reportedly resident in the city of Sirte and the terrorist group is expanding its influence along the Mediterranean coast; whereas there has been a surge of foreign fighters travelling to join terrorist organisations in Libya;

B. whereas extremist infiltration undermines the efforts aimed at restoring security in Sinai; whereas various Al-Qaida-affiliated or -inspired terrorist groups continue to operate in the area; whereas some of these groups have extended the scope of their terrorist actions beyond Sinai; whereas other local militants operating in Sinai do not belong to any extremist group but are armed Bedouins involved in smuggling and human trafficking;

These include in particular the replacement of structured and hierarchical groups by semi-autonomous cells or lone actors and the increased use of the internet to inspire, mobilise, instruct and train local terrorist networks and individuals.[9] The provisions in place to implement FD 2002 were considered insufficient in that conduct such as disseminating messages of public provocation which did not actually incite a particular person to commit a terrorist offence, disseminating messages encouraging people to become terrorists without reference to a specific terrorist offence, or disseminating on the internet terrorist expertise not aimed at supporting the activities of a specific terrorist group, were not necessarily criminalised.

Regarding penalties, it introduces a principle of "aggravating circumstance" by providing that "terrorist offences" and certain offences linked to terrorism must be punishable by custodial sentences heavier than those imposable under national law for such offences in the absence of a terrorist intent, it sets the minimum level of the maximum penalty at 15 years for directing a terrorist group and 8 years for participation in a terrorist group, it enumerates a series of penalties that can be imposed on bodies corporate (in particular exclusion from entitlement to public benefits or aid, temporary or permanent disqualification from the practice of commercial activities, placing under judicial supervision, judicial winding-up order and closure of establishments), it provides for a system of "repentis" by providing for specific circumstances in which Member States may reduce prison sentences where the terrorist renounces terrorist activity or provides the administrative or judicial authorities with information.

Considers that, although efforts for the peaceful resolution of conflicts and management of crises must have a high priority, it is necessary to be firm in denying terrorists any reward for their crimes, especially in the interests of victims and their families and in squeezing out serious organised crime from globalised trade; reiterates that the EU rejects any attempt to justify, excuse, tolerate or condone acts of terrorism by any act or declaration that does not reject those terrorist activities; any attempt to pay tribute to members of terrorist groups or to misuse democratic institutions for the benefit of terrorist groups must be condemned;
