4. La décision ou la convention de subvention peut autoriser ou imposer, sous forme de taux forfaitaires, le financement des coûts indirects du bénéficiaire, à hauteur de 7 % maximum du total des coûts directs éligibles de l'action, sauf si le bénéficiaire reçoit une subvention de fonctionnement financée sur le budget.
4. The grant decision or agreement may authorise or impose, in the form of flat-rates, funding of the beneficiary's indirect costs up to a maximum of 7 % of total eligible direct costs for the action, except where the beneficiary is in receipt of an operating grant financed from the budget.

3. Lorsque les actions externes sont cofinancées au moyen à la fois des crédits inscrits dans le budget et des recettes affectées externes visées à l'article 21, paragraphe 2, point b), les fonds qui ne sont pas engagés à l'échéance du délai d'adjudication visé à l'article 189, paragraphe 2, pour l'action concernée sont remboursés au prorata, déduction faite d'un montant forfaitaire correspondant à l'audit, à l'évaluation et aux provisions pour imprévus qui peuvent être engagées ultérieurement.
3. Where external actions are co-financed both from appropriations entered in the budget and from external assigned revenue referred to in point (b) of Article 21(2), the funds which are not committed after the end of the contracting period referred to in Article 189(2) for the relevant action shall be reimbursed on a pro rata basis after the deduction of a lump sum corresponding to audit, evaluation and contingencies which can be committed at a later time.

Considers, in particular, that the increases in the standard abatement rates, meant to increase the number of unpaid posts within the institutions, reflect a conservative approach which will directly affect the possibility to improve occupancy rates of the establishment plans that are at the same time being approved by the budget authority; emphasises that such an approach is all the more detrimental in a context of reduction of establishment plans, which mechanically improves occupancy rates, and that the financing of these posts should not be considered as an adjustment variable for achieving a nominal freeze of administrative budget or any other predefined target amount;

Likewise, in its Decision No 96-385 DC of 30 December 1996, the Constitutional Council pointed out that the flat-rate contribution of FRF 37,5 billion was justified by the State financing of the retirement pensions of the civil servants, without constituting compensation, whereas, on the other hand, the payments to the State budget would not be earmarked for a specific expenditure and would contribute to the general conditions for the balance of this budget, in accordance with Article 18 of the Ordinance of 2 January 1959 on the Organic Law relating to Finance Bills (ordonnance organique du 2 janvier 1959 relative aux lois de finances).
