Where, during official controls performed on animals or goods originating in another Member State, the competent authorities establish that such animals or goods do not comply with the rules referred to in Article 1(2) in such a way as to create a risk to human, animal or plant health, animal welfare or, as regards GMOs and plant protection products, also to the environment, or to constitute a potentially serious infringement of those rules, they shall, without delay, notify the competent authorities of the Member State of dispatch and of any other concerned Member State in order to enable those competent authorities to undertake appropriate investigations.

Si le principal lieu d'activité d'un intermédiaire d'assurance est situé dans un autre État membre, l'autorité compétente de cet autre État membre peut convenir avec l'autorité compétente de l'État membre d'origine d'agir comme si elle était l'autorité compétente de l'État membre d'origine en ce qui concerne les obligations prévues aux chapitres VI, VII et VIII de la présente directive.

If an insurance intermediary's primary place of business is located in another Member State, then the competent authority of that other Member State may agree with the home Member State competent authority to act as if it were the home Member State competent authority with regard to the obligations in chapters VI, VII and VIII of this Directive.

In the event of a change in any of the particulars communicated pursuant to points (b), (c) or (d) of Article 35(2), a credit institution shall give written notice of the change in question to the competent authorities of the home and host Member States at least one month before making the change so as to enable the competent authorities of the home Member State to take a decision pursuant to Article 35 and the competent authorities of the host Member State to take a decision setting out the conditions for the change pursuant to paragraph 1 of this Article.

8. In the event of change of any particulars communicated in accordance with paragraph 2(b), (c) or (d), a management company shall give written notice of that change to the competent authorities of the management company’s home Member State and of the management company’s host Member State at least one month before implementing the change so that the competent authorities of the management company’s home Member State may take a decision on the change under paragraph 3 and the competent authorities of the management company’s host Member State may do so under paragraph 6.

2. Toute décision de retrait de l’agrément ou toute autre mesure grave prise à l’égard de l’OPCVM ou toute suspension de l’émission, du rachat ou du remboursement de ses parts qui lui serait imposée est communiquée sans délai par les autorités de l’État membre d’origine de l’OPCVM aux autorités des États membres d’accueil de l’OPCVM et, dans le cas où la société de gestion d’un OPCVM est établie dans un autre État membre, aux autorités compétentes de l’État membre d’origine de la société de gestion.

Should the content of the information communicated in accordance with paragraph 1(b) be amended, the management company shall give notice of the amendment in writing to the competent authorities of the home Member State and of the host Member State before implementing the change, so that the competent authorities of the host Member State may, if necessary, inform the company of any change or addition to be made to the information communicated under paragraph 3.
