The competent authority may take an individual decision on behalf of another national authority concerned, if the decision by that authority is not delivered within the time limit and if the delay cannot be adequately justified; or, where provided under national law, and to the extent that this is compatible with Union law, the competent authority may consider that another national authority concerned has either given its approval or refusal for the project if the decision by that authority is not delivered within the time limit.

Provided that this complies with the right to a fair trial, the following situations do not constitute a deprivation of liberty within the meaning of this Directive: identifying the suspect or accused person; determining whether an investigation should be started; verifying the possession of weapons or other similar safety issues; carrying out investigative or evidence-gathering acts other than those specifically referred to in this Directive, such as body checks, physical examinations, blood, alcohol or similar tests, or the taking of photographs or fingerprints; bringing the suspect or accused person to appear before a competent authority, in accordance with national law.

Provided that this complies with the right to a fair trial, the obligation for Member States to provide children who are suspects or accused persons with assistance by a lawyer in accordance with this Directive does not include the following: identifying the child; determining whether an investigation should be started; verifying the possession of weapons or other similar safety issues; carrying out investigative or evidence-gathering acts other than those specifically referred to in this Directive, such as body checks, physical examinations, blood, alcohol or similar tests, or the taking of photographs or fingerprints; or bringing the child to appear before a competent authority or surrendering the child to the holder of parental responsibility or to another appropriate adult, in accordance with national law.

In order for processing to be lawful, personal data should be processed on the basis of the consent of the data subject concerned or some other legitimate basis, laid down by law, either in this Regulation or in other Union or Member State law as referred to in this Regulation, including the necessity for compliance with the legal obligation to which the controller is subject or the necessity for the performance of a contract to which the data subject is party or in order to take steps at the request of the data subject prior to entering into a contract.

establish and maintain close contact with all the parties to the peace and transition process in the African Great Lakes Region, other countries of the region, the United States of America, other relevant countries, as well as the United Nations (UN) and other relevant international organisations, the African Union (AU) and subregional organisations and their representatives as well as other prominent regional leaders in order to work with them in strengthening the peace processes of Lusaka and Arusha and the peace agreements concluded in Pretoria and Luanda;

a) d'établir et de maintenir des contacts étroits avec toutes les parties au conflit dans la région des Grands lacs africains, d'autres pays de la région, les États-Unis d'Amérique, d'autres pays concernés ainsi qu'avec les Nations unies et les autres organisations internationales concernées, l'UA et des organisations sous-régionales, leurs représentants et d'autres dirigeants influents de la région en vue d'oeuvrer avec eux au renforcement des processus de paix de Lusaka et d'Arusha ainsi qu'aux accords de paix conclus à Pretoria et Luanda;
(a) establish and maintain close contact with all the parties to the conflicts in the African Great Lakes Region, other countries of the region, the United States of America, other relevant countries, as well as the UN and other relevant international organisations, the AU and subregional organisations and their representatives as well as other prominent regional leaders in order to work with them in strengthening the peace processes of Lusaka and Arusha and the peace agreements concluded in Pretoria and Luanda;

(11) Il convient que le mandat du Haut-Commissariat des Nations unies pour les réfugiés concernant les réfugiés et d'autres personnes ayant besoin d'une protection internationale soit respecté et qu'il soit donné effet à la déclaration n° 17, annexée à l'acte final du traité d'Amsterdam, relative à l'article 63 du traité instituant la Communauté européenne, aux termes de laquelle il est procédé à des consultations sur les questions touchant à la politique d'asile avec le Haut-Commissariat des Nations unies pour les réfugiés et avec d'autres organisations internationales concernées.
(11) The mandate of the United Nations High Commissioner for Refugees regarding refugees and other persons in need of international protection should be respected, and effect should be given to Declaration No 17, annexed to the Final Act to the Treaty of Amsterdam, on Article 63 of the Treaty establishing the European Community which provides that consultations are to be established with the United Nations High Commissioner for Refugees and other relevant international organisations on matters relating to asylum policy.

Any term not otherwise defined in this Agreement or in Annexes I or II will, unless the context otherwise requires or the Competent Authority of a Member State and the Competent Authority of Liechtenstein agree to a common meaning as provided for in Article 7 (as permitted by domestic law), have the meaning that it has at that time under the law of the jurisdiction concerned applying this Agreement, (i) for Member States, under Council Directive 2011/16/EU on administrative cooperation in the field of taxation or, where applicable, the domestic law of the Member State concerned, and (ii) for Liechtenstein, under its domestic law, any meaning under the applicable tax laws of the jurisdiction concerned (being a Member State or Liechtenstein) prevailing over a meaning given to the term under other laws of that jurisdiction.
