Les dérogations prévues au paragraphe 1 ne s'appliquent pas lorsqu'une entreprise ferroviaire exploitant des services ferroviaires en Irlande ou en Irlande du Nord présente une demande officielle visant à exploiter des services ferroviaires sur le territoire d'un autre État membre ou à destination ou en provenance de celui-ci, à l'exception de l'Irlande pour les entreprises ferroviaires exerçant leur activité en Irlande du Nord et du Royaume-Uni pour les entreprises ferroviaires exerçant leur activité en Irlande.
The derogations referred to in paragraph 1 shall not apply where a railway undertaking operating railway services in Ireland or Northern Ireland submits an official application to operate railway services on, to or from the territory of another Member State, with the exceptions of Ireland for railway undertakings operating in Northern Ireland and the United Kingdom for railway undertakings operating in Ireland.

1. 1. Member States shall ensure that the necessary measures are taken in order to ensure that investments made by a railway undertaking or an infrastructure manager for the training of a driver do not unduly benefit another railway undertaking or infrastructure manager in the case where that driver voluntarily leaves the former for the latter railway undertaking or infrastructure manager.

‘railway undertaking’ means any railway undertaking as defined in Directive 2001/14/EC of the European Parliament and of the Council of 26 February 2001 on the allocation of railway infrastructure capacity and the levying of charges for the use of railway infrastructure (14), and any other public or private undertaking, the activity of which is to provide transport of goods and/or passengers by rail on the basis that the undertaking must ensure traction.
