Definition: This block contains a wide variety of disorders that differ in severity and clinical form but that are all attributable to the use of one or more psychoactive substances, which may or may not have been medically prescribed. - LA RECONNAISSANCE MUTUELLE DANS LES ETATS MEMBRES DE LA VALIDITE DES ORDONNANCES MEDICALES "LE CONSEIL DE L'UNION EUROPEENNE, vu le traité instituant la Communauté européenne, considérant que le Conseil, dans sa résolution du 30 novembre 1995 relative à l'intégration dans les politiques communautaires des exigences en matière de protection de la santé, considère que la Communauté doit accorder une attention particulière à l'incidence sur la santé des actions proposées dans un certain nombre de domaines, y inclus la libre circulation des marchandises, considérant que des actions destinées à améliorer la compréhension et traiter des incidences sur la santé humaine de la libre circulation des marchandises et en particulier de la libre circulation des médicaments, doivent faire partie de la stratégie globale d'action de la Communauté dans le domaine de la santé publique, considérant que le marché intérieur implique l'existence d'un espace sans frontières intérieures dans lequel la libre circulation des marchandises, des personnes, des services et des capitaux est assurée ; considérant que les patients, lorsqu'ils se déplacent d'un Etat membre à l'autre, pourraient en pratique se voir empêcher d'acquérir les médicaments prescrits par un médecin agréé d'un autre Etat membre ; considérant qu'en application du traité et de la directive 93/16/CEE tout traitement discriminatoire pour des raisons de nationalité est interdit en matière d'établissement et de prestation de services dans le domaine de la pratique médicale ; considérant que la présente résolution ne porte pas atteinte aux dispositions qui régissent le paiement ou le remboursement des médicaments par les régimes nationaux de sécurité sociale ; considérant également que la présente résolution ne concerne pas les ordonnances relatives à des substances classées par les conventions internationales des Nations Unies parmi les stupéfiants ou les substances psychotropes, dans des proportions qui placent cette substan ...
- MUTUAL RECOGNITION OF THE VALIDITY OF MEDICAL PRESCRIPTIONS IN THE MEMBER STATES "THE COUNCIL OF THE EUROPEAN UNION, Having regard to the Treaty establishing the European Community, Whereas, in its Resolution of 30 November 1995 on the integration of health protection requirements in Community policies, the Council considers that the Community must pay particular attention to the impact on health of action proposed in a number of areas, including free movement of goods; Whereas action to improve understanding of and address the impact on human health of the free movement of goods, in particular the free movement of medicinal products, should form part of the Community's overall strategy for action in the field of public health; Whereas the internal market comprises an area without internal frontiers in which the free movement of goods, persons, services and capital is ensured; Whereas patients, in moving from one Member State to another, could in practice be prevented from purchasing medicinal products prescribed by an authorized medical practitioner in another Member State; Whereas, pursuant to the Treaty and to Directive 93/16/EEC, all discriminatory treatment based on nationality with regard to establishment and provision of services is prohibited in medical practice; Whereas this Resolution does not affect provisions governing the financing or reimbursement of the cost of medicinal products by national social security schemes; Whereas, moreover, this Resolution does not cover prescriptions for a non-exempt dose of a substance classified as a narcotic drug or psychotropic substance under United Nations international conventions, CALLS on the Commission, in cooperation with the Member States and taking account of work in this area by the relevant international organizations, to look into the present position with regard to the mutual recognition of medical prescriptions in the Member States.
