IN-CONTEXT TRANSLATIONS

Dans ce contexte, la juridiction bulgare a saisi la Cour de justice pour lui poser tout d’abord deux questions d’ordre procédural, à savoir si, lorsqu’elle réexamine la situation de l’intéressé à l’issue du délai initial de rétention, l’autorité administrative compétente doit adopter un acte écrit motivé en droit et en fait et si le contrôle de légalité d’un tel acte nécessite que l’autorité judiciaire compétente puisse statuer sur le fond de l’affaire.
Against that background the Bulgarian court has referred a number of questions to the Court of Justice for a preliminary ruling. The first two questions concern procedural matters, namely (i) whether, when it re-examines the situation of the person concerned at the end of an initial period of detention, the competent administrative authority must adopt a measure in writing with reasons being given in fact and in law and (ii) whether the review of the legality of such a measure requires that the court having jurisdiction be able to give a decision on the merits of the case.

In that regard, a provision of the Framework Decision precludes the judicial authorities from refusing to execute a European arrest warrant issued for the purpose of executing a sentence in a situation where the person concerned has not appeared in person at the trial where, having been made aware of the scheduled trial, he gave a mandate to a legal counsellor to defend him at the trial and was in fact defended by that counsellor.
