(28) Furthermore, in order to create greater legal certainty it is necessary to define the responsibilities regarding the transparency rules for the Agency's work, to set certain conditions for the marketing of medicinal products authorised by the Community, to confer on the Agency powers to monitor the distribution of medicinal products authorised by the Community and to specify the sanctions and the procedures for implementing them in the event of failure to observe the provisions of this Regulation and the conditions contained in the authorisations granted under the procedures it establishes.

(7) il importe que les patients souffrant de telles affections aient droit à des médicaments dont la qualité, la sécurité et l'efficacité sont équivalentes à celles des médicaments dont bénéficient les autres patients; il y a donc lieu de soumettre les médicaments orphelins à la procédure d'évaluation habituelle; il y a lieu que les promoteurs de médicaments orphelins aient la possibilité d'obtenir une autorisation communautaire; afin de faciliter l'octroi ou le maintien de cette autorisation communautaire, il y a lieu d'accorder une dispense, au moins partielle, de la redevance due à l'agence et de prévoir le dédommagement de la perte de recettes qui en résulte pour cette dernière au moyen d'une contribution prélevée sur le budget communautaire;
(7) patients with such conditions deserve the same quality, safety and efficacy in medicinal products as other patients; orphan medicinal products should therefore be submitted to the normal evaluation process; sponsors of orphan medicinal products should have the possibility of obtaining a Community authorisation; in order to facilitate the granting or the maintenance of a Community authorisation, fees to be paid to the Agency should be waived at least in part; the Community budget should compensate the Agency for the loss in revenue thus occasioned;

(7) À l'exception des médicaments soumis à la procédure communautaire centralisée d'autorisation prévue par le règlement (CEE) n° 2309/93 du Conseil du 22 juillet 1993 établissant des procédures communautaires pour l'autorisation et la surveillance des médicaments à usage humain et à usage vétérinaire et instituant une agence européenne pour l'évaluation des médicaments(7), une autorisation de mise sur le marché délivrée par une autorité compétente d'un État membre devrait être reconnue par les autorités compétentes des autres États membres, à moins qu'elles aient de sérieux motifs de supposer que l'autorisation du médicament vétérinaire en question puisse présenter un danger pour la santé humaine ou animale ou pour l'environnement. Dans l'éventualité d'un désaccord entre les États membres sur la qualité, la sécurité et l'efficacité d'un médicament vétérinaire, une évaluation scientifique de la question devrait être réalisée au niveau communautaire, afin d'aboutir à une décision unique sur les points litigieux, et contraignante pour les États membres concernés.
(7) With the exception of those medicinal products which are subject to the centralised Community authorization procedure established by Council Regulation (EEC) No 2309/93 of 22 July 1993 laying down Community procedures for the authorization and supervision of medicinal products for human and veterinary use and establishing a European Agency for the Evaluation of Medicinal Products(7), a marketing authorization in one Member State ought to be recognized by the competent authority of the other Member States unless there are serious grounds for supposing that the authorization of the veterinary medicinal product concerned may present a risk to human or animal health, or to the environment; in the event of a disagreement between Member States about the quality, the safety or the efficacy of a medicinal product, a scientific evaluation of the matter should be undertaken at a Community level, lead to a single decision on the area of disagreement, binding on the Member States concerned.
