It claims that, since, in accordance with case-law, only an ability to distinguish the origin of the goods is sufficient for the ground of refusal referred to in Article 7(1)(b) of Regulation No 40/94 not to apply and given that the marks had minimal distinctive character, which the General Court accepted in qualifying them as original, the latter erred in law, infringing that provision, by denying the distinctive character of the marks even though the protection criterion was met.
