2. Lorsqu'il n'est pas possible de procéder à la confiscation sur la base du paragraphe 1, à tout le moins lorsque cette impossibilité résulte d'une maladie ou de la fuite du suspect ou de la personne poursuivie, les États membres prennent les mesures nécessaires pour permettre la confiscation des instruments ou produits dans le cas où une procédure pénale a été engagée concernant une infraction pénale qui est susceptible de donner lieu, directement ou indirectement, à un avantage économique et où ladite procédure aurait été susceptible de déboucher sur une condamnation pénale si le suspect ou la personne poursuivie avait été en mesure de comparaître en justice.
2. Where confiscation on the basis of paragraph 1 is not possible, at least where such impossibility is the result of illness or absconding of the suspected or accused person, Member States shall take the necessary measures to enable the confiscation of instrumentalities and proceeds in cases where criminal proceedings have been initiated regarding a criminal offence which is liable to give rise, directly or indirectly, to economic benefit, and such proceedings could have led to a criminal conviction if the suspected or accused person had been able to stand trial.

Pour qu’une telle démarche puisse être pertinente dans un cas comme celui de l’espèce, la Commission devrait évaluer: i) si un juge aurait condamné l’État membre pour avoir suspendu, sans concertation avec la direction de l’entreprise le plan social en question; ii) le montant que l’État membre aurait pu être condamné à payer dans cette éventualité; et iii) le degré de probabilité d’une telle éventualité (176).
In order for such a step to be relevant in a case such as this one, the Commission should ascertain (i) whether a court would censure the Member State for having suspended the social plan in question without consulting the undertaking’s management (ii) the amount which the Member State could have been ordered to pay in that eventuality and (iii) the degree of probability of that eventuality (176).

Conformément au paragraphe 3, le paragraphe 1 ne s’applique pas dans la mesure où, si la condamnation antérieure avait été une condamnation nationale dans l’État membre où se déroule la nouvelle procédure, la prise en compte de la condamnation antérieure aurait eu pour effet, conformément au droit national dudit État membre, d’influer sur la condamnation antérieure ou toute décision relative à son exécution, de les révoquer ou de les réexaminer.
4. In accordance with paragraph 3, paragraph 1 shall not apply to the extent that, had the previous conviction been a national conviction of the Member State conducting the new proceedings, the taking into account of the previous conviction would, according to the national law of that Member State, have had the effect of interfering with, revoking or reviewing the previous conviction or any decision relating to its execution.

5. Si l’infraction à l’origine de la nouvelle procédure a été commise avant que la condamnation antérieure ne soit prononcée ou entièrement exécutée, les paragraphes 1 et 2 n’ont pas pour effet d’obliger les États membres à appliquer leurs règles nationales en matière de prononcé des peines, lorsque l’application de ces règles à des condamnations prononcées à l’étranger aurait pour conséquence de limiter le pouvoir qu’a le juge d’imposer une peine dans le cadre de la nouvelle procédure.
5. If the offence for which the new proceedings being conducted was committed before the previous conviction had been handed down or fully executed, paragraphs 1 and 2 shall not have the effect of requiring Member States to apply their national rules on imposing sentences, where the application of those rules to foreign convictions would limit the judge in imposing a sentence in the new proceedings.

Par conséquent, si certains actes, que sanctionne une condamnation antérieure, ne sont pas punissables dans un État membre donné, il sera impossible à la juridiction d'y «attacher des effets juridiques équivalents», car il n’y aurait eu absolument aucun effet juridique s'il s'était agi d'une procédure purement nationale[3].
Hence, if certain acts, on which a previous conviction is based, are not punishable in a certain Member State, it will be impossible for the courts to "attach equivalent legal effects" as there would have been no legal effects at all if it concerned a purely domestic case.[3]
