Malgré l'ambiguïté—sinon l'absence—de critères aptes à départager «les aspects pertinents de la Constitution» des «aspects politiques des négociations constitutionnelles» (100), la Cour est parfaitement justifiée à mon avis d'utiliser sa discrétion en matière d'accueil des pouvoirs pour écarter ceux auxquels elle ne peut apporter aucun éclairage valable.
Despite the ambiguity—if not the absence—of criteria to separate " the relevant aspects of the Constitution" from " the political aspects of constitutional negotiations" (100), in my opinion the Court is perfectly justified in using its discretion in the matter of deciding what powers it should exercise in order to determine those on which it can bring some light.
