In this respect, it should be noted that, in accordance with the general principle of equality of treatment embodied in Community law, Member States which impose penal sanctions for infringement of a national patent must ensure equivalent protection in cases of infringement of the Community patent.

3. Aux fins du paragraphe 2, le contrefacteur qui a son domicile ou son siège dans un Etat membre dont la langue officielle, qui est également une langue officielle de la Communauté, n'est pas la langue dans laquelle le brevet a été délivré ou dans laquelle une traduction du brevet a été mise à la disposition du public conformément à l'article 58, est présumé, jusqu'à preuve du contraire, ne pas avoir su ni ne pas avoir eu des motifs raisonnables de savoir qu'il portait atteinte au brevet.
3. For the purposes of paragraph 2, an alleged infringer who has his residence or principal place of business in a Member State whose official language, which is also an official language of the Community, is not the language in which the patent was granted or in which a translation of the patent has been made public in accordance with Article 58, is presumed, in the absence of proof to the contrary, not to have known nor to have had reasonable grounds for knowing that he was infringing the patent.

Dans une telle situation, un contrefacteur présumé qui n'a pas pu avoir recours au texte du brevet dans la langue officielle de l'Etat membre où il est domicilié, est présumé, jusqu'à preuve contraire, ne pas sciemment porter atteinte au brevet.
In such a situation, a suspected infringer who has been unable to consult the text of the patent in the official language of the Member State in which he is domiciled, is presumed, until proven otherwise, not to have knowingly infringed the patent.

Le paragraphe 3 accorde en faveur du contrefacteur visé à ce paragraphe une présomption selon laquelle celui-ci ne savait pas ni ne pouvait savoir qu'il portait atteinte au brevet, dans le cas où le brevet n'a pas été délivré dans la langue officielle de l'Etat membre où il est domicilié ou traduite et mise à la disposition du public dans cette langue.
Paragraph 3 provides for an assumption being made in favour of the infringer referred to in this paragraph, to the effect that he did not know, and could not have known, that he was infringing the patent if the patent was not issued in the official language of the Member State in which he is domiciled, or if it was not translated and made available to the general public in that language.
