These limitations violate EU law on the freedom of establishment (Article 49 of TFEU), the free movement of capital (Article 63 of TFEU), and 31 and 40 of the Agreement on the European Economic Area (EEA) which guarantee the right to establishment and the free movement of capital in the EU and the EEA.

Having assessed the reply by the Hungarian authorities, the Commission maintains its legal assessment that the law as amended is not compatible with the fundamental internal market freedoms, notably the freedom to provide services (Article 56 TFEU and Article 16 of Directive 2006/123/EC on services in the internal market) and the freedom of establishment (Article 49 TFEU and Articles 9, 10, 13, 14 of Directive 2006/123/EC), but also not compatible with the right of academic freedom, the right to education and the freedom to conduct a business as provided by the Charter of Fundamental Rights of the European Union (Articles 13, 14, 16 respectively), as well as not compatible with the Union's legal obligations under international trade law (the General Agreement on Trade in Services – GATS – in the framework of the World Trade Organisation, WTO).

7. se félicite de la décision du Conseil européen de signer les chapitres politiques de l'accord d'association avant l'élection présidentielle en Ukraine; se félicite de l'engagement du Conseil européen à veiller à ce que l'Union européenne adopte unilatéralement des mesures qui permettront à l'Ukraine de tirer largement profit des avantages que comporte l'accord de libre-échange approfondi et complet, tels l'application de dispositions relatives à l'importation de biens, notamment la réduction des droits de douane et l'ouverture des contingents tarifaires; réitère que les parties en suspens de l'accord d'association et de l'accord de libre‑échange approfondi et complet devraient être signées aussi rapidement que possible; insiste sur le fait que des signaux clairs sont nécessaires pour signaler à la Russie qu'il n'y a rien dans cet accord qui mette en péril les relations futures de coopération politique et économique entre l'Ukraine et la Russie ou qui porte préjudice à ces relations; se félicite que le Conseil ait récemment reconnu que l'accord d'association, y compris un accord de libre-échange approfondi et complet, ne constituait pas l'objectif final de la coopération UE – Ukraine; souligne, en outre, que l'article 49 du traité UE fait mention de tous les États européens, dont l'Ukraine, qui est dotée d'une perspective européenne et peut introduire une demande d'adhésion à l'Union, pour autant qu'elle adhère aux principes de la démocratie, qu'elle respecte les libertés fondamentales, ainsi que les droits de l'homme et des minorités, et qu'elle garantisse l'état de droit;
7. Welcomes the decision of the European Council to sign the political chapters of the Association Agreement before the presidential elections in Ukraine; welcomes the European Council’s commitment to ensuring that the EU unilaterally adopts measures that will allow Ukraine to benefit substantially from the advantages offered in the Deep and Comprehensive Trade Area, such as the application of provisions related to the import of goods by reducing tariffs and opening tariff rate quotas; reiterates that the outstanding parts of the AA/DCFTA should be signed as soon as possible; insists on the need for clear signals demonstrating to Russia that nothing in this agreement endangers or harms future cooperative bilateral political and economic relations between Ukraine and Russia; welcomes the recent recognition by the Council that the Association Agreement, including a DCFTA, does not constitute a final goal in EU-Ukraine cooperation; stresses, furthermore, that Article 49 TEU refers to all European states, including Ukraine, which has a European perspective, and may apply to become a Member of the Union, provided that it adheres to the principles of democracy, respects fundamental freedoms and human and minority rights, and ensures the rule of law;

A. while on the one hand, the existing primary law of the European Community does not confer on the Community any responsibility for sport in general or for professional football in particular, on the other hand neither are they excluded from the scope of application and, among other things, the case-law of the European Court of Justice (Court of Justice) and decisions taken by the European Commission make clear that in particular the ban on discrimination imposed by Article 12 of the EC Treaty, the principle of freedom of movement for workers enshrined in Article 39 thereof, the freedom of establishment and the freedom to provide services laid down in Articles 43 and 49 thereof, the provisions on competition set out in Articles 81 to 87 thereof and the provisions on employment and social policy have had an impact on sport and professional football,

La Commission a-t-elle connaissance des cas de discrimination et des dispositions contraires aux traités (traité d'adhésion, annexe XII, libre circulation des personnes, point 13 et, en particulier, les mesures transitoires sur la libre circulation des personnes) présentes dans la législation nationale d'États membres de l'Union tels que l'Autriche, les Pays-Bas ou l'Italie, qui permettent de telles pratiques, ainsi que des cas de violation par l'Allemagne de l'article 49, premier alinéa, du traité CE et de l'article 1 de la directive 96/71/CE concernant le détachement de travailleurs temporaires par une agence de travail temporaire?
Does the Commission know of examples of discrimination or of regulations which contravene the treaties (the Treaty of Accession, Annex XII, Freedom of movement for persons, paragraph 13, and in particular the transitional regulations on the freedom of movement of persons) found in the national laws of the EU Member States of Austria, the Netherlands and Italy, which allow such practices, or is it aware of any breaches by Germany of Article 49, first paragraph, of the Treaty establishing the European Community and Article 1 of Directive 96/71/EC relating to the posting of temporary workers through temporary employment agencies?
