TRADUCTIONS EN CONTEXTE

1. Les dispositions du règlement d’application se substituent à celles des arrangements relatifs à l’application des conventions visées à l’article 8, paragraphe 1, du règlement de base, à l’exception des dispositions concernant les arrangements relatifs aux conventions visées à l’annexe II du règlement de base, pour autant que les dispositions desdits arrangement soient inscrites à l’annexe 1 du règlement d’application.

The provisions of the implementing Regulation shall replace those laid down in the arrangements for the application of the conventions referred to in Article 8(1) of the basic Regulation, except the provisions concerning the arrangements concerning the conventions referred to in Annex II to the basic Regulation, provided that the provisions of those arrangements are included in Annex 1 to the implementing Regulation.

2. Member States may conclude between themselves, if necessary, arrangements pertaining to the application of the conventions referred to in Article 8(2) of the basic Regulation provided that these arrangements do not adversely affect the rights and obligations of the persons concerned and are included in Annex 1 to the implementing Regulation.

(7) Subsection 212(6) does not apply to interest on any bond or other obligation described therein that was issued after December 20, 1960, except any such bond or other obligation for the issue of which arrangements were made on or before that day with a dealer in securities, if the existence of the arrangements for the issue of the bond or other obligation can be established by evidence in writing given or made on or before that day.

In the light of a consistent historical pattern of including monetary compensation as part of treaty arrangements, the continuing representations in federal claims policy that compensation is an integral element of modern treaties as well as the explicit undertaking by Canada in the Nunavik Negotiation Framework Agreement of August 19, 1993 that compensation was a subject- matter for negotiations, there certainly should be no ambiguity on the matter.

Ms. Jeannette Gill-Skulski: In cases where there is divorce and both parties are not in agreement on the child custody arrangement, there could be a court-appointed social worker or investigator sent out to determine the truth about how the family has functioned before and after the break-up, and only after thorough investigation, where a testimony is heard from the children, parents, extended family, teachers, doctors, close friends and neighbours, can the courts truly make a fair judgment on what's best for the children.
