Definition: This block contains a wide variety of disorders that differ in severity and clinical form but that are all attributable to the use of one or more psychoactive substances, which may or may not have been medically prescribed. The third character of the code identifies the substance involved, and the fourth character specifies the clinical state. The codes should be used, as required, for each substance specified, but it should be noted that not all fourth character codes are applicable to all substances. Identification of the psychoactive substance should be based on as many sources of information as possible. These include self-report data, analysis of blood and other body fluids, characteristic physical and psychological symptoms, clinical signs and behaviour, and other evidence such as a drug being in the patient's possession or reports from informed third parties. Many drug users take more than one type of psychoactive substance. The main diagnosis should be classified, whenever possible, according to the substance or class of substances that has caused or contributed most to the presenting clinical syndrome. Other diagnoses should be coded when other psychoactive substances have been taken in intoxicating amounts (common fourth character .0) or to the extent of causing harm (common fourth character .1), dependence (common fourth character .2) or other disorders (common fourth character .3-.9). Fourth plea in law, alleging (i) infringement of the requirement that pleadings are to be construed in accordance with their actual terms and of the principle that actions are to be assessed on the basis of the information existing at the time the contested measure was adopted, in that the CST took the view, in paragraph 77 of its order, that the appellant based his arguments, derived from the principle of equal treatment, on the consequences of the contested decision and rejected them in any event on the basis of those consequences; and (ii) infringement of the obligation to state reasons, the principle that the provisions of the Staff Regulations are to be interpreted in accordance with the principle of equality and the principle of equality itself, in that the CST, in paragraphs 77 and 78 to 80 of its order, failed to respond to the requisite legal standard to the appellant’s arguments.

In the present case, it is settled that the decision rejecting the complaint does not contain a re-examination of the applicant’s situation in the light of new elements of law or of fact, but upholds the decision to recruit the applicant at grade AD 5, step 2, as contained in the applicant’s contract of employment, and is confined to addressing the claims and arguments put forward by the applicant and providing some clarification regarding the grounds for that grading decision.

La requérante considère que le TFP a, tout d’abord, violé l’article 43, paragraphe 1, du règlement de procédure du TFP en omettant de prendre en compte le fait que les arguments en cause étaient fondés sur des documents et des informations que la FRA n’a produits qu’au cours de la procédure devant le TFP et a, ensuite, omis de reconnaître que les arguments en cause devaient être considérés comme recevables au motif qu’ils étaient étroitement liés avec les autres moyens avancés au cours de la procédure écrite. The appellant considers that the CST, first, infringed the first paragraph of Article 43 of the Rules of Procedure of the CST by failing to take account of the fact that the submissions at issue were based on documents and information which the FRA produced only in the course of the proceedings before the CST and, second, failed to recognise that the submissions at issue must be held to be admissible on the ground that they were closely connected with other pleas submitted in the written procedure. Third, and in any event, the CST erroneously concluded, without any motivation, that the plea was not among the pleas which the Tribunal may raise of its own motion.

Fourth ground of appeal: Finally, the General Court infringed the duty to provide grounds for its decisions, laid down in Article 81 of the Rules of Procedure of the General Court in conjunction with Articles 36 and 53(1) of the Statute of the Court of Justice, since it is not apparent from the grounds for the judgment under appeal that the General Court addressed the appellant’s claims relating to the inadmissibility of flat-rate financial corrections (first part of the second ground of appeal) or the reasons for rejecting those claims are not apparent.

The arguments that certain supporting documents were not taken into account relate not to the existence or adequacy of the statement of reasons but to the soundness of the reasons, which goes to the substantive legality of the contested measure (see to that effect the judgment in Case C‑17/99 France v Commission [2001] ECR I‑2481, paragraph 35), and will therefore be examined in the context of the eighth plea.
