BC. whereas following the allegations published by the media, the Commission decided to open consultations with the US pursuant to Article 19 of the TFTP Agreement; whereas on 27 November 2013 Commissioner Malmström informed the LIBE Committee that, after meeting US authorities and in view of the replies given by the US authorities in their letters and during their meetings, the Commission had decided not to pursue the consultations on the grounds that there were no elements showing that the US Government has acted in a manner contrary to the provisions of the Agreement, and that the US has provided written assurance that no direct data collection has taken place contrary to the provisions of the TFTP agreement; whereas it is not clear whether the US authorities have circumvented the Agreement by accessing such data through other means, as indicated in the letter of 18 September 2013 from the US authorities ;

3. De sa propre initiative, après avoir procédé à une consultation publique et consulté le CERS, et, le cas échéant, les autorités compétentes de pays tiers, l'AEMF répertorie, conformément aux critères fixés au paragraphe 4, points a), b) et c), et notifie à la Commission les catégories de produits dérivés qui devraient être soumises à l'obligation de compensation prévue à l'article 4 mais pour la compensation desquelles aucune contrepartie centrale n'a encore reçu d'agrément.

ESMA shall, on its own initiative, after conducting a public consultation and after consulting the ESRB and, where appropriate, the competent authorities of third countries, identify, in accordance with the criteria set out in points (a), (b) and (c) of paragraph 4 and notify to the Commission the classes of derivatives that should be subject to the clearing obligation provided in Article 4, but for which no CCP has yet received authorisation.

5. ESA (ESMA) shall, on its own initiative and in consultation with the European Systemic Risk Board (ESRB), as well as following consultation where appropriate with the European and third country supervisory authorities responsible for specific trading markets, identify and notify to the Commission the classes of derivatives contracts that should be included in its public register, but for which no CCP has yet received authorisation.
