Definition: This block contains a wide variety of disorders that differ in severity and clinical form but that are all attributable to the use of one or more psychoactive substances, which may or may not have been medically prescribed. The third character of the code identifies the substance involved, and the fourth character specifies the clinical state. The codes should be used, as required, for each substance specified, but it should be noted that not all fourth character codes are applicable to all substances. Identification of the psychoactive substance should be based on as many sources of information as possible. First plea in law, alleging an error of law, since the Civil Service Tribunal (‘the CST’) held, first, that the failure, by the EEAS, to adopt the general provisions (‘GP’) of Article 10 of Annex X to the Staff Regulations of Officials of the European Union (‘the regulations’) was justified by the fact that the EEAS was still, as regards the application of that provision, in an adjustment period and, secondly, that the failure to fulfil the obligation to adopt the GP can be successfully invoked by the appellant only where he shows that the EEAS applied that provision arbitrarily.

[7] In case 241/05 the European Court of Justice ruled that Article 20(1) of the Convention implementing the Schengen Agreement is to be interpreted as meaning that the term ‘first entry’ in that provision refers, besides the very first entry into the territories of the Contracting States to that agreement, to the first entry into those territories taking place after the expiry of a period of six months from that very first entry and also to any other first entry taking place after the expiry of any new period of six months following an earlier date of first entry.

In order to allow the Member States to benefit from a less burdensome situation resulting from the adjusted intensity of controls, and taking into account that according to Article 19(2) of Regulation (EC) No 595/2004 controls are carried out partly during the 12-month period in question, partly after the 12-month period, it is appropriate to apply the adjusted intensity of controls for the 12-month period 2007/2008, i.e. the period starting on 1 April 2007 and finishing on 30 March 2008.
