Au moment de l'adoption par la Commission de son premier rapport, certains Etats membres (Allemagne, France, Irlande, Luxembourg) avaient déjà préparé une nouvelle législation complétant ou modifiant la législation pénale existante et spécialement conçue pour appliquer la décision-cadre, mais qui n'était pas encore entrée en vigueur à l'époque.
When the Commission adopted its first report, some Member States (France, Germany, Ireland, and Luxembourg) had prepared new legislation which complemented or amended existing criminal law and which was specifically designed to implement the Framework Decision but had not entered into force at the time.

Le CEPD conseille vivement au législateur d'étendre le champ d'application, en obligeant — et non en se contentant d'inviter — les États membres à appliquer la décision-cadre au traitement national des données à caractère personnel.
The EDPS strongly advises the legislator to extend the scope of applicability, by obliging — not only inviting — Member States to apply the Framework Decision to domestic processing of personal data.
