Par conséquent, la clause de résiliation ne saurait s’appliquer, à l’issue d’un concours général ouvert à l’ensemble des ressortissants des États membres, en présence d’une liste d’aptitude réduite au point que les chances des agents concernés d’échapper à son application étaient déraisonnablement trop minces, au regard de l’engagement pris par l’institution à l’égard de son personnel temporaire.
