In order to ensure uniform conditions for the implementation of this Regulation and to avoid unfair competition or discrimination between farmers, implementing powers should also be conferred on the Commission in respect of: adopting rules on the procedure, including on the timetables for their submission, for the Member States' notifications and the Commission assessment as regards equivalent practices; adopting certain limits within which the obligation to maintain permanent grassland is considered to be being complied with; setting out the annual ceiling for the payment for agricultural practices beneficial for the climate and the environment; setting out the annual ceiling for the payment for areas with natural constraints; setting out the annual ceiling for the payment for young farmers.

2. Les États membres collectent les données visées au paragraphe 1 de la présente disposition et, avant le 15 de chaque mois civil, communiquent par voie électronique à la Commission ou à un organisme désigné par celle-ci, pour chaque stock, groupe de stocks ou catégorie de pêche, les données sur les quantités capturées et, si un accord ou règlement portant modalités d'application de cet accord l'exige, sur l'effort déployé au cours du mois précédent par les navires battant leur pavillon, dans les eaux qui entrent dans le champ d'application d'un accord, et au cours des six mois précédents pour les activités de pêche en dehors des eaux communautaires et qui n'entrent pas dans le champ d'application d'un accord.
2. Member States shall collect the data referred to in paragraph 1 of this Article and, before the 15th of each calendar month, shall submit by electronic transmission to the Commission, or to a body designated by the Commission, data for each stock, group of stocks or fishing category, on the quantities caught, and, where required under an agreement or regulation implementing that agreement, on the fishing effort deployed during the previous month by vessels flying their flag in the waters falling under the scope of an agreement and in the previous six months for fishing activities outside Community waters not falling under the scope of an agreement.

6. Si la partie concernée ne notifie pas les mesures d'application avant l'expiration du délai raisonnable ou si le groupe d'arbitrage décide que les mesures d'application notifiées par la partie concernée sont incompatibles avec ses obligations au titre de la présente partie de l'accord, la partie plaignante a le droit, faute d'accord sur la compensation, de suspendre l'application d'avantages accordés en vertu de la présente partie de l'accord jusqu'à concurrence du niveau de l'annulation ou de la réduction dû à la mesure jugée contraire à la présente partie de l'accord.
6. If the Party concerned fails to notify the implementing measures before the expiry of the reasonable timeframe or if the arbitration panel rules that the implementing measures notified by the Party concerned are inconsistent with its obligations under this Part of the Agreement, the complaining Party shall, if no agreement on compensation has been found, be entitled to suspend the application of benefits granted under this Part of the Agreement equivalent to the level of nullification and impairment caused by the measure found to violate this Part of the Agreement.

L’Accord définitif renferme également des dispositions relatives à la transition entre l’application de la Loi sur les Indiens et l’application de l’Accord définitif dans certains domaines (ch. 3); aux relations entre la Première Nation de Tsawwassen et le gouvernement régional (ch. 17); au mécanisme de résolution des conflits auquel recourir en cas de conflit entre les parties au sujet de l’interprétation, de la mise en œuvre ou de l’application de l’Accord ou encore en cas de non-respect de l’Accord (ch. 22).
The TFA also contains provisions relating to the transition from the Indian Act’s application to TFN in certain areas (Chapter 3); to relationships between TFN and regional government (Chapter 17); and to a dispute-resolution mechanism to apply to conflicts among the Parties over the TFA’s interpretation, application or implementation, or a breach of the TFA (Chapter 22).
