3. Lorqu'une entreprises d'investissement exécute un ordre, le critère de la nature professionnelle de l'investisseur, aux fins de l'application des règles visées au paragraphe 1, est apprécié par rapport à l'investisseur qui est à l'origine de l'ordre, que celui-ci soit placé directement par l'investisseur lui-même ou indirectement par l'intermédiaire d'une entreprise d'investissement offrant le service visé à la section A point 1 a) de l'annexe.
3. Where an investment firm executes an order, for the purposes of applying the rules referred to in paragraph 1 the professional nature of the investor shall be assessed with respect to the investor from whom the order originates, regardless of whether the order was placed directly by the investor himself or indirectly through an investment firm providing the service referred to in Section A (1) (a) of the Annex.
