in the light of any information received, the Commission may at any time amend the specifications relating to the third country and may suspend the entry of that country from the list referred to in Article 7; a similar decision may also be made where a third country has not supplied information required or where it has not agreed to an on-the-spot examination.

5. If, after a third country has been included in the list in Annex I, any changes are made to the measures in force in the third country or their implementation, that third country shall notify the Commission thereof.

2. La dérogation prévue au paragraphe 1 s'applique lorsque l'organe de gestion compétent de l'État membre, le cas échéant après avoir consulté les autorités compétentes d'un pays tiers, a la certitude que les irrégularités survenues ne sont pas imputables à l'importateur ou au (ré)exportateur, et que l'importation ou la (ré)exportation des spécimens concernés est par ailleurs conforme aux dispositions du règlement (CE) no 338/97, de la convention et de la législation applicable du pays tiers.
2. The derogation provided for in paragraph 1 shall apply where the competent management authority of the Member State, in consultation with the competent authorities of a third country where appropriate, is satisfied that any irregularities which have occurred are not attributable to the importer or the (re-)exporter, and that the import or (re-)export of the specimens concerned is otherwise in compliance with Regulation (EC) No 338/97, the Convention and the relevant legislation of the third country.

6. Lorsque des parties de projets d'intérêt commun se situent sur le territoire de pays tiers, la Commission peut, en accord avec les États membres concernés, faire des propositions, le cas échéant dans le cadre de la gestion des accords entre la Communauté et ces pays tiers, et conformément aux dispositions du traité sur la Charte de l'énergie et d'autres accords multilatéraux applicables aux pays tiers signataires de ce traité, pour que ces projets soient également reconnus d'intérêt mutuel par les pays tiers concernés, en vue de faciliter leur mise en œuvre.
6. Where parts of projects of common interest are situated within the territory of third countries, the Commission may, in agreement with the Member States concerned, put forward proposals, where appropriate within the framework of the management of the agreements between the Community and those third countries and in accordance with the Energy Charter Treaty and other multilateral agreements with third countries which are parties to that Treaty, for the projects also to be recognised as being of mutual interest by the third countries concerned, in order to facilitate their implementation.

6. (12) Whereas the sector/country graduation system should also continue to apply to beneficiary countries whose exports of products covered by the generalised system of preferences (GSP) in a given sector exceeded 25 % of all beneficiaries' exports of those products in that sector in the statistical reference year of the previous scheme, irrespective of their level of development;
