Existing Union legislation regulating the field covered by this Regulation also includes Directive 2002/87/EC of the European Parliament and of the Council of 16 December 2002 on the supplementary supervision of credit institutions, insurance undertakings and investment firms in a financial conglomerate , Directive 98/78/EC of the European Parliament and of the Council of 27 October 1998 on the supplementary supervision of insurance undertakings in an insurance group , Regulation (EC) No 1781/2006 of the European Parliament and of the Council of 15 November 2006 on information on the payer accompanying transfers of funds , and the relevant parts of Directive 2005/60/EC of the European Parliament and of the Council of 26 October 2005 on the prevention of the use of the financial system for the purpose of money laundering and terrorist financing and of Directive 2002/65/EC of the European Parliament and of the Council of 23 September 2002 concerning the distance marketing of consumer financial services

2. Lorsque l'appartenance, la participation ou l'accès à un organisme réglementaire autonome, à une Bourse ou un marché des valeurs mobilières ou des instruments à terme, à un établissement de compensation, ou à toute autre organisation ou association est exigé par la Communauté pour que les prestataires chiliens de services financiers puissent fournir des services financiers sur un pied d'égalité avec les prestataires communautaires de services financiers, ou lorsque la Communauté accorde directement ou indirectement à ces entités des privilèges ou des avantages pour la fourniture de services financiers, elle fera en sorte que lesdites entités accordent le traitement national aux prestataires chiliens de service financiers résidents sur son territoire.

When membership or participation in, or access to, any self-regulatory body, securities or futures exchange or market, clearing agency, or any other organisation or association, is required by the Community in order for financial service suppliers of Chile to supply financial services on an equal basis with financial service suppliers of the Community, or when the Community provides directly or indirectly such entities, privileges or advantages in supplying financial services, the Community shall ensure that such entities accord national treatment to Chilean financial service suppliers resident in its territory.

Without prejudice to Article 13, the exercise of supplementary supervision at the level of the financial conglomerate shall in no way imply that the competent authorities are required to play a supervisory role in relation to mixed financial holding companies, third-country regulated entities in a financial conglomerate or unregulated entities in a financial conglomerate, on a stand-alone basis.
