4. If, on the basis of available scientific and technological information, the Commission, has reason to believe that the use of the specific feed may not fulfil the particular intended nutritional purpose or may have adverse effects on animal health, human health, the environment or animal welfare, the Commission shall, within three months of receipt of a valid application, seek an opinion from the European Food Safety Authority (hereinafter referred to as ‘the Authority’).

After an additive has been authorised in accordance with this Regulation, any person using or placing on the market that substance, or a feedingstuff into which it has been incorporated, or any other interested party shall ensure that any conditions or restrictions which have been imposed on the placing on the market, use and handling of the additive or feedingstuffs containing it are respected.

4. Si, sur la base des informations scientifiques et techniques disponibles, la Commission a des raisons de croire que l'utilisation de l'aliment pour animaux en question pourrait ne pas répondre à l'objectif nutritionnel particulier auquel il est destiné ou pourrait avoir des effets négatifs sur la santé animale, la santé humaine, l'environnement et le bien-être des animaux, elle transmet une demande d'évaluation et le dossier à l'Autorité européenne de sécurité des aliments («l'Autorité») dans un délai de trois mois.

If, on the basis of available scientific and technical information, the Commission has reasons to believe that the use of the specific feed may not meet the particular intended nutritional purpose or may have adverse effects on animal health, human health, the environment and animal welfare, the Commission shall forward a request for a assessment together with the dossier to the European Food Safety Authority (‘the Authority’) within three months.

3. 3. Where a Member State finds that a unit as referred to in Article 2, which is correctly maintained and used for its intended purpose, is liable to endanger the health and/or safety of persons and, where appropriate, domestic animals or property, during transport and/or use, notwithstanding the fact that it bears a CE marking and an indication of periodic inspection, it may restrict the placing on the market or use of this unit or have it withdrawn from the market or from circulation.
