BC. whereas following the allegations published by the media, the Commission decided to open consultations with the US pursuant to Article 19 of the TFTP Agreement; whereas on 27 November 2013 Commissioner Malmström informed the LIBE Committee that, after meeting US authorities and in view of the replies given by the US authorities in their letters and during their meetings, the Commission had decided not to pursue the consultations on the grounds that there were no elements showing that the US Government has acted in a manner contrary to the provisions of the Agreement, and that the US has provided written assurance that no direct data collection has taken place contrary to the provisions of the TFTP agreement; whereas it is not clear whether the US authorities have circumvented the Agreement by accessing such data through other means, as indicated in the letter of 18 September 2013 from the US authorities ;

The European Commission, already addressed on these issues in the Radwan report, has chosen to draft a proposal that does not involve those who are responsible for the stability of the financial markets, that was drawn up hastily with American authorities who are reaching the end of their mandate and have been disowned by all the candidates in the American presidential election, and without consulting the Council or the European Parliament.

1. 1. The status of the U.S. contingent assigned to an EU crisis management operation, and in particular the privileges and immunities they enjoy, shall be governed by the agreement on the status of the mission (the status agreement) concluded between the EU and the State in which the operation is being conducted, provided that: (a) the United States shall be afforded an opportunity to examine the status agreement prior to deciding whether or not to participate in the operation and (b) if no status agreement has been concluded at the time it is needed for examination, the Parties shall consult and agree on an appropriate alternative arrangement concerning the status of the U.S. contingent prior to its deployment, without prejudice to the EU’s overall responsibility for concluding host country arrangements on the status of EU personnel and units.

6. Considers that, given the scope thereof and the fact that they affect the rights and freedoms of individual citizens, these agreements must be deemed by the Council to be ‘basic choices’ for the Union and that, consequently, Parliament must be consulted pursuant to Articles 21, 34(2)(c) and 39(1) of the EU Treaty; believes, furthermore, that simple information of Parliament during the ratification phase, which the Council referred to in the House, cannot be deemed to be satisfactory from either a political or a constitutional point of view; calls on the Council as a matter of urgency to consult the European Parliament in the same way as the American authorities consult the US Congress;
