Grant, in its entirety, the claim in the application made at first instance to the effect that Article 1(1) of Commission Decision 2013/448/EU (1) of 5 September 2013 concerning national implementation measures for the transitional free allocation of greenhouse gas emission allowances in accordance with Article 11(3) of Directive 2003/87/EC of the European Parliament and of the Council (notified under document C(2013) 5666) is annulled in so far as it rejects the inscription of the installation listed in Annex I, Point A, to that decision with the installation identifier DE000000000000563 on the list of installations covered by Directive 2003/87/EC (2) which Germany submitted to the Commission pursuant to Article 11(1) of Directive 2003/87/EC and the corresponding preliminary annual amounts of emission allowances allocated free of charge to these installations;

Grant, in its entirety, the first head of claim in the application made at first instance to the effect that Article 1(1) of Commission Decision 2013/448/EU (1) of 5 September 2013 concerning national implementation measures for the transitional free allocation of greenhouse gas emission allowances in accordance with Article 11(3) of Directive 2003/87/EC of the European Parliament and of the Council (notified under document C(2013) 5666) is annulled in so far as it rejects the inscription of the installations listed in Annex I, Point A, to that decision with the installation identifiers DE000000000001320 and DE-new-14220-0045 on the list of installations covered by Directive 2003/87/EC which Germany submitted to the Commission pursuant to Article 11(1) of Directive 2003/87/EC and the corresponding preliminary annual amounts of emission allowances allocated free of charge to these installations;

Aux fins de l’allocation de quotas d’émission aux nouveaux entrants, à l’exception de l’allocation aux installations visées à l’article 3, point h), troisième alinéa, de la directive 2003/87/CE, les États membres calculent séparément pour chaque sous-installation le nombre annuel provisoire de quotas d’émission alloués à titre gratuit à compter du début de l’exploitation normale de l’installation, de la manière suivante:

For the purposes of the allocation of emission allowances to new entrants, with the exception of allocations to installations referred to in the third indent of Article 3(h) of Directive 2003/87/EC, Member States shall calculate the preliminary annual number of emission allowances allocated free of charge as of the start of normal operation of the installation for each sub-installation separately, as follows:

iii)la sous-installation concernée par les modifications physiques a un niveau d’activité nettement supérieur entraînant une allocation supplémentaire de quotas d’émission de plus de 50 000 quotas par an, représentant au moins 5 % du nombre annuel provisoire de quotas d’émission alloués à titre gratuit à la sous-installation en question avant la modification.
(iii)the sub-installation to which the physical changes relate has a significantly higher activity level resulting in an additional allocation of emission allowances of more than 50 000 allowances per year representing at least 5 % of the preliminary annual number of emission allowances allocated free of charge for this sub -installation before the change.

Il ne sera pas soulevé d’objection si un État membre modifie les quantités annuelles totales provisoires de quotas d’émission allouées à titre gratuit aux installations situées sur son territoires qui figurent sur les listes visées au paragraphe 1 et qui sont énumérées à l’annexe I, point C, de la présente décision avant de déterminer la quantité annuelle totale définitive pour la période 2013-2020 conformément à l’article 10, paragraphe 9, de la décision 2011/278/UE, pour autant que la modification consiste à rendre l’allocation conforme aux dispositions de l’article 10, paragraphe 2, point a), de la décision 2011/278/UE et à exclure toute allocation pour les procédés couverts par les limites du système du référentiel de produit de la fonte liquide telle que définie à l’annexe I de ladite décision à une installation qui importe de la fonte liquide mais n’en produit pas, ce qui aurait pour effet d’entraîner un double comptage.
No objections are raised should a Member State amend the preliminary total annual amounts of emission allowances allocated free of charge to installations in its territory included in the lists referred to in paragraph 1 and listed in point C of Annex I to this Decision before determining the final total annual amount for each year from 2013 to 2020 in accordance with Article 10(9) of Decision 2011/278/EU to the extent that the amendment consists of bringing the allocation in line with Article 10(2)(a) of Decision 2011/278/EU and excluding any allocation for processes that are covered by the system boundaries of the product benchmark for hot metal as defined in Annex I to Decision 2011/278/EU to an installation not producing, but importing hot metal that would otherwise lead to double counting.

Au cas où il en résulte une augmentation de l’allocation provisoire sur la base d’une sous-installation avec référentiel de combustibles ou de chaleur dans une installation comprenant un haut fourneau énumérée à l’annexe I, point D, de la présente décision, il ne sera pas soulevé d’objection si l’État membre concerné modifie en conséquence la quantité annuelle totale provisoire de cette installation.
Where this leads to an increase of the preliminary allocation under the fuel or heat benchmark sub-installation in an installation with a blast furnace and listed in point D of Annex I to this Decision, no objections are raised should the Member State concerned amend the preliminary total annual amount of this installation accordingly.

Il ne sera pas soulevé d’objection si un État membre modifie les quantités annuelles totales provisoires de quotas d’émission allouées à titre gratuit aux installations situées sur son territoire qui figurent sur les listes visées au paragraphe 1 et qui sont énumérées à l’annexe I, point B, de la présente décision avant de déterminer la quantité annuelle totale définitive pour la période 2013-2020 conformément à l’article 10, paragraphe 9, de la décision 2011/278/UE, pour autant que la modification consiste à exclure toute allocation sur la base du référentiel de la fonte liquide aux installations qui importent de la fonte liquide telle que définie à l’annexe I de la décision 2011/278/UE en vue de sa transformation.
No objections are raised should a Member State amend the preliminary total annual amounts of emission allowances allocated for free to installations in its territory included in the lists referred to in paragraph 1 and listed in point B of Annex I to this Decision before determining the final total annual amount for each year from 2013 to 2020 in accordance with Article 10(9) of Decision 2011/278/EU to the extent that the amendment consists of excluding any allocation on the basis of the hot metal benchmark to installations importing hot metal as defined in Annex I to Decision 2011/278/EU for further processing.

For installations covered by Article 10a(3) of Directive 2003/87/EC and eligible for the allocation of free emission allowances, the final total annual amount of emission allowances allocated free of charge shall correspond to the preliminary total annual amount of emission allowances allocated free of charge for each installation determined in accordance with paragraph 7 annually adjusted by the linear factor referred to in Article 10a(4) of Directive 2003/87/EC, using the preliminary total annual amount of emission allowances allocated free of charge for the installation concerned for 2013 as a reference.
