Les arômes et les ingrédients alimentaires possédant des propriétés aromatisantes cités ci-après peuvent être utilisés dans ou sur les denrées alimentaires sans faire l’objet d’une évaluation et d’une autorisation en application du présent règlement, à la condition qu’ils soient conformes à l’article 4:

It should also cover certain food ingredients with flavouring properties which are added to food for the main purpose of adding flavour and which contribute significantly to the presence in food of certain naturally occurring undesirable substances (hereinafter referred to as food ingredients with flavouring properties), their source material and foods containing them.

Depuis 1999, le comité scientifique de l’alimentation humaine, puis l’Autorité européenne de sécurité des aliments (ci-après dénommée «l’Autorité») instituée par le règlement (CE) no 178/2002 du Parlement européen et du Conseil du 28 janvier 2002 établissant les principes généraux et les prescriptions générales de la législation alimentaire, instituant l’Autorité européenne de sécurité des aliments et fixant des procédures relatives à la sécurité des denrées alimentaires , ont émis des avis sur diverses substances, naturellement présentes dans les matériaux de base des arômes et des ingrédients alimentaires possédant des propriétés aromatisantes, qui, selon le comité d’experts sur les matières aromatisantes du Conseil de l’Europe, suscitent des préoccupations sur le plan toxicologique.
Since 1999, the Scientific Committee on Food and subsequently the European Food Safety Authority (hereinafter referred to as the Authority) established by Regulation (EC) No 178/2002 of the European Parliament and of the Council of 28 January 2002 laying down the general principles and requirements of food law, establishing the European Food Safety Authority and laying down procedures in matters of food safety have expressed opinions on a number of substances occurring naturally in source materials for flavourings and food ingredients with flavouring properties which, according to the Committee of Experts on Flavouring Substances of the Council of Europe, raise toxicological concern.

Sans préjudice des dispositions du règlement (CE) no 110/2008, les quantités maximales en certaines substances, naturellement présentes dans les arômes et/ou dans les ingrédients alimentaires possédant des propriétés aromatisantes, dans les denrées alimentaires composées figurant sur la liste de l’annexe III, partie B, ne doivent pas être dépassées par suite de l’utilisation d’arômes et/ou d’ingrédients alimentaires possédant des propriétés aromatisantes dans et sur ces denrées alimentaires.
2. Without prejudice to Regulation (EC) No 110/2008, maximum levels of certain substances, naturally present in flavourings and/or food ingredients with flavouring properties, in the compound foods listed in Part B of Annex III shall not be exceeded as a result of the use of flavourings and/or food ingredients with flavouring properties in and on those foods.
