Pour répondre à ces demandes et malgré l’absence d’accord sur le traité constitutionnel, l’Union a accompli un certain nombre d'avancées notables, à savoir un accord concernant un cadre financier sur sept ans, un programme redynamisé en faveur de la croissance et de l'emploi dans le cadre de la stratégie de Lisbonne révisée, un nouveau programme social, un pacte de stabilité et de croissance réformé, un plan d’action visant à renforcer l’espace européen de liberté, de sécurité et de justice, le doublement de l’aide officielle au développement d’ici 2010, ainsi qu’un accord politique sur des sujets sensibles tels que la législation relative aux services et aux produits chimiques et un accord sur un projet de nouvelle politique énergétique.
To respond to these demands, and despite the absence of agreement on the Constitutional Treaty, the EU has taken a number of significant steps forward: agreement to a seven year financial framework, a reinvigorated agenda for growth and jobs under the revised Lisbon Strategy, a new social agenda, a reformed Stability and Growth Pact, an Action Plan to strengthen the EU area of freedom, security and justice, a doubling of official development aid by 2010, as well as political agreement on sensitive issues such as legislation on services and chemicals, and agreement to the outline of a new energy policy.

However, the European Parliament is putting its focus on the consideration that the present agreement should be written ‘in the context of the overall framework of existing agreements between the European Community and the Republic of Korea and those currently under negotiation, in particular the negotiations concerning a potential free trade agreement’, namely, and as the rapporteur underlines, taking into account ‘the problems that have been encountered by other bilateral and interregional trade negotiations’.

La législation de l'UE en la matière exigeant une évaluation préalable du niveau de protection des données assuré par les pays tiers, la Commission est intervenue à cet effet et a négocié des accords PNR avec ces pays[67]. Elle a signé un tel accord avec les États-Unis en juillet 2007 et avec l'Australie en juin 2008, ainsi qu'un accord API/PNR avec le Canada en octobre 2005[68]. Les accords conclus avec les États-Unis et l'Australie sont provisoirement applicables, tandis que l'accord avec le Canada reste en vigueur malgré l'expiration, en septembre 2009, de la décision de la Commission relative à l'adéquation du niveau de protection des données assuré par les normes canadiennes de protection des données[69]. As the relevant EU legislation requires prior assessment of the level of data protection guaranteed by third countries, the Commission stepped in to perform this function and negotiated PNR agreements with these countries.[67] It signed the US agreement in July 2007, the Australian one in June 2008 and an API/PNR agreement with Canada in October 2005.[68] The US and Australian agreements are provisionally applicable, while the Canadian one remains in force despite the expiry, in September 2009, of the Commission’s adequacy decision concerning Canadian data protection standards.[69] Critical of their content, the European Parliament has called on the Commission to renegotiate all three agreements on the basis of a clear set of principles.[70] Sent well in advance of a flight’s departure, PNR data help law enforcement authorities screen passengers for potential links to terrorism and other forms of serious crime.

I just want to ask you a non-legal and institutional question: if we look, for instance, at the decision which was taken to submit the Uruguay Round conclusions to the assent of this Parliament, there were some legal questions relating to the institutional and budgetary implications of the Agreement, but the decision was fundamentally a political recognition that this was an agreement of such importance that the strict boundaries of what was then Article 113 could, so to speak, be overstepped, thus allowing the Agreement to be submitted to Parliament's assent.
