Regrets that according to the audit report on the annual accounts of the Trans-European Transport Network Executive Agency, the Agency does not perform the satisfactory ex ante verification on the charges for its premises invoiced by the building manager resulting in EUR 113 513 of VAT unduly paid and not recovered in 2013 by the Executive Agency; notes that most of the underlying contracts, invoices and receipts were not at the Executive Agency's disposal; points out to the high carry over rate for Title II (27% equivalent to EUR 666 119) which raises questions to the sound financial management of this Executive Agency;

L'article 55, paragraphe 1, du règlement (CE, Euratom) n° 1605/2002 du 25 juin 2002 portant règlement financier applicable au budget des Communautés européennes permet une telle délégation sous certaines conditions et définit une agence de la manière suivante: les agences exécutives sont des personnes morales de droit communautaire créées par décision de la Commission auxquelles peut être déléguée la totalité ou une partie de la mise en oeuvre, pour le compte de la Commission et sous sa responsabilité, d'un programme ou projet communautaire.
Article 55(1) of the Regulation (EC, Euratom) No. 1605/2002 of 25 June 2002 on the Financial Regulation applicable to the general budget of the European Communities permits the delegation to third parties of public authority tasks in principle under certain conditions, and defines an EA as follows: ‘The executive agencies shall be legal persons under Community law created by Community decision to which powers can be delegated to implement all or part of a Community programme or project on behalf of the Commission and under its responsibility’.
