Gestions Ritvik inc.42, la Cour suprême avait à se prononcer sur la constitutionnalité de l’alinéa 7b) de la LMC et avait conclu qu’il « est suffisamment intégré au régime de réglementation fédéral et diffère sensiblement de l’alinéa 7e) à cet égard » et donc qu’il respecte la compétence législative du gouvernement fédéral43.
In 2005, in Kirkbi AG v. Ritvik Holdings Inc.,42 the Supreme Court had to rule on the constitutionality of paragraph 7(b) of the Trade-marks Act and concluded that it “is sufficiently integrated into the federal scheme and, in this respect, is significantly different from s. 7(e)” and therefore lies within the federal government’s legislative competence.43 In its ruling, the Court also reaffirmed its position in MacDonald et al. v. Vapor Canada Ltd. in which it struck down paragraph 7(e) “on the ground that it was unrelated to trade or to trade-marks, or other forms of intellectual property subject to federal legislative authority”.
