63. prend acte de l'arrêt de la Cour de justice dans les affaires jointes Volker und Markus Schecke GbR (C-92/09) et Hartmut Eifert (C-93/09) et de la nécessité qui en résulte d'effectuer une pondération équilibrée entre "l'intérêt de l'Union à garantir la transparence de ses actions et une utilisation optimale des fonds publics, d'une part, et l'atteinte au droit des bénéficiaires concernés au respect de leur vie privée, en général, et à la protection de leurs données à caractère personnel, en particulier, d'autre part" (arrêt Volker und Markus Schecke GbR (C-92/09), paragraphe 77); souligne, cependant, que la Cour de justice a rappelé la validité du principe de transparence (Volker und Markus Schecke, paragraphe 68), tel qu'énoncé aux articles 1 et 10 du traité sur l'Union européenne et à l'article 15 du traité sur le fonctionnement de l'Union européenne et a également souligné que "la publication au moyen d'Internet des données nominatives relatives aux bénéficiaires concernés [(.) renforce] le contrôle public sur l'utilisation des sommes concernées et [contribue] à une utilisation optimale des fonds publics" (Volker und Markus Schecke, paragraphe 75);

Notes the judgment of the Court of Justice in Joined Cases Volker and Markus Schecke GbR C-92/09 and Hartmut Eifert C-93/09 and the subsequent need to balance "the European Union's interest in guaranteeing the transparency of its acts and ensuring the best use of public funds against the interference with the right of the beneficiaries concerned to respect for their private life in general and to the protection of their personal data in particular" (Volker and Markus Schecke GbR C-92/09, paragraph 77 of the judgment); stresses however that the Court of Justice has recalled the validity of the principle of transparency (Volker and Markus Schecke, paragraph 68) as stated in Articles 1 and 10 of the Treaty on European Union and in Article 15 of the Treaty on the Functioning of the European Union and has also underlined that "publication on the Internet of data by name relating to the beneficiaries concerned [...] reinforces public control of the use to which that money is put and contributes to the best use of public funds" (Volker and Markus Schecke, paragraph 75);
