en premier lieu, le Tribunal a mal interprété et mal appliqué l’article 266 du traité sur le fonctionnement de l’Union européenne (ci-après le «TFUE» ou le «traité») en liaison avec l’article 263 TFUE et le principe d’effectivité, le principe d’attribution des compétences, le principe de sécurité juridique, le principe de continuité de l’ordre juridique, l’application de la loi dans le temps, le principe de la confiance légitime et les principes régissant la succession des règles dans le temps, dans la mesure où il a annulé certaines décisions de la Commission ayant pour objet l’exécution des obligations qui lui incombaient en vertu des arrêts rendus dans les affaires jointes T-218/03 à T-241/03, Boyle e.a./Commission et dans les affaires jointes C-373/06 P, C-379/06 P et C-382/06 P, Flaherty e.a./Commission.
First, the General Court misinterpreted and misapplied Article 266 of the Treaty on the Functioning of the European Union (‘TFEU’ or ‘the Treaty’) in conjunction with Article 263 TFEU and the principle of effectiveness, the principle of conferral of powers, the principle of legal certainty, the principle of continuity of the legal order, the temporal application of law, the principle of legitimate expectations and the principles governing succession of legal rules, insofar as it annulled certain Commission decisions intended to carry out the Commission’s obligations under the judgments in Joined Cases T-218/03 to T-241/03, Boyle and others v Commission and Joined Cases C-373/06 P, C-379/06 P and C-382/06 P, Flaherty and others v Commission.

La présente décision apporte une précision importante concernant la notion d'aide d'État au sens du droit de l'UE car elle confirme que la viabilisation de terrains par une autorité locale est une mission de service public et que cette appréciation n’a pas changé après les arrêts rendus par les juridictions de l'UE dans l'affaire Leipzig/Halle (affaires jointes T-443/08 et T-455/08) et affaire C-288/11 P).
This decision provides an important clarification as regards the notion of state aid under EU law because it confirms that the development of land by a local authority is a public task and that this qualification has not changed after the Leipzig/Halle judgments of the EU Courts (joined cases T-443/08 and T-455/08 and case C-288/11 P).

Même si la mesure n’a pas changé en substance depuis la décision de la Commission de 2003, l’Allemagne a néanmoins décidé de notifier ce régime une nouvelle fois vu les arrêts du Tribunal et de la Cour de justice dans l'affaire Leipzig/Halle (affaires jointes T-443/08 et T-455/08 et affaire C-288/11 P).
Although the essence of the measure has not changed since the Commission's 2003 decision, Germany decided to re-notify the scheme in light of the Leipzig/Halle judgments of the EU General Court (Joined cases T-443/08 and T-455/08) and the EU Court of Justice (case C-288/11 P).
